Enforcement and security proceedings in Slovenia are regulated by the Claim
Enforcement and Security Act. The purpose and main objective of the master’s thesis
is to present enforcement proceedings in which a creditor decides to pursue judicial
debt recovery through the seizure and sale of the debtor’s real estate. In March 2018,
the Slovenian legislature introduced online public auctions, in order to ensure all
necessary technical and practical conditions for the implementation of online public
auctions, the SodneDrazbe.si portal was launched on 1 February 2021. The primary
purpose of the research is to examine the advantages and disadvantages of
introducing online public auctions and to provide guidance for employees and bidders,
as well as to propose legislative amendments. The aim is to present a comparative
international overview of real estate enforcement proceedings in the Germany, Austria,
and Croatia in comparison with the regulation in the Slovenia.
The selection of the topic of this master’s thesis is based on practical experience
gained from the regular use of the SodneDrazbe.si portal. Using the responses
obtained from the completed survey of employees (editors) and a detailed review of
selected files, the advantages and disadvantages of online judicial public auctions are
presented through both graphical and descriptive analysis. Part of the research
includes a comparison of case files of the Local Court in Trebnje in which judicial public
auctions of the debtor’s real estate were scheduled and conducted. The detailed
analysis showed that the introduction of the SodneDrazbe.si portal increased the
success rate of real estate sales and resulted in higher final sale prices. The next part
of the research is based on survey methodology. Analysis of the completed
questionnaires revealed that the introduction of the portal contributed to time savings
and a high level of satisfaction among a large number of editors.
The main finding of the master’s thesis is that the introduction of the SodneDrazbe.si
portal makes the real estate enforcement procedure more user-friendly for potential
buyers and editors, as well as faster and more effective in terms of creditor satisfaction.
The main challenge of the research lies in the limited number of previous similar
studies and in the diversity of legal regulations governing enforcement on real estate
in the selected countries. The key contribution of the master’s thesis is to use the obtained data and analyses to define more precisely the advantages of introducing online judicial public auctions and to provide proposals for further development and improvement.
