The master's thesis examines the institution of special legal protection against termination of employment contracts in Slovenia, focusing on the analysis of the existing normative framework, highlighting the main theoretical and practical challenges and identifying the possibilities for future improvements (de lege ferenda). Four groups of specially protected workers are discussed in individual chapters, namely, workers' representatives, workers before retirement, parents, and disabled persons and persons absent from work due to illness. For these groups, the law provides special protection against termination due to their vulnerable position. After an introduction to the legal framework, each group under consideration is followed by sub-chapters presenting and analysing the existing shortcomings. Workers enjoy special protection against dismissal because of one of their personal circumstances, i.e. their role as workers' representatives, age, parenthood, disability and illness, which puts them in a weaker position vis-à-vis their employer. The legal framework therefore seeks to protect them from discrimination, preserve their employment and ensure their social security. The aim of this master’s thesis is to analyze whether the existing regulation of special legal protection against dismissal is adequate and effective, and to identify key shortcomings with the purpose of proposing changes that would contribute to improving the legal and actual position of these vulnerable groups of workers.
