The Forest Act, adopted in 1993, provides the fundamental legal framework for forest management in Slovenia and defines the rights, obligations, and limitations of private forest owners. The objective of this master’s thesis was to examine the restrictive impact of the provisions of the Forest Act and its subordinate legislation on the management of private forests. Based on a survey conducted among private forest owners in the Slovenj Gradec area, we aimedto determine the extent to which individual legal provisions are perceived by private owners as restrictive in forest management. The survey included 182 private forest owners, 73.0 % of whom were men, with an average age of 50 years and an average forest holding size of 27.4 hectares. Private forest owners attached the highest value to management objectives related to the role of forests in mitigating climate change and preserving biodiversity, confirming their awareness of the broader importance of sustainable forest management. The most significant constraints arising from legislative provisions were related to the procedures for obtaining financial support for forest investments and the availability of public funds for financing and co-financing such activities. In addition, respondents reported being restricted by excessive legal limitations on property rights and by the unrestricted access of third parties to forests, the latter posing a greater challenge particularly for owners of forest properties larger than 10 hectares. Overall, private forest owners believe that the Forest Act requires amendments and updates, as its current provisions do not enable effective management of private forests. Differences were observed in the perception of legal restrictions depending on the size of the forest holdings and the degree of owners’ management activity, clearly indicating the need for a more differentiated legislative approach that would better account for the heterogeneous structure of private forest owners and provide greater flexibility in line with their individual needs and management objectives.
