The diploma thesis is dedicated to the study of transport law, with a focus on railway transport of passengers, luggage, and cargo, as well as an analysis of Slovenian case law in this field.
The initial part defines transport and railway law. It presents a brief chronological overview of the development and unification of railway law, along with the regulatory framework for passenger, cargo, and luggage transport at both domestic and international levels. The discussion primarily revolves around private law regulations related to passenger, luggage, and cargo transport, with an emphasis on the provisions of the Zakon o železniškem prevozu potnikov, tovora in prtljage (ZPPŽP), which is the most significant domestic law governing contractual relations between carriers and either passengers or transport service clients.
The second part of the thesis defines the concept and significance of case law and provides summaries of specific Slovenian court cases related to railway transport of passengers, luggage, and cargo. Slovenian case law in this area is relatively scarce. To illustrate the importance of unification and ratification of various conventions in different countries, two examples of foreign case law concerning passenger transport are included.
The aim of the thesis is to provide a thorough review and summary of the legislation on railway transport of passengers, luggage, and cargo, with a focus on private law regulations. The presentation of legislation serves as a foundation for reviewing, analyzing, and interpreting Slovenian case law, which completes the thesis.
