The use of the court rulings in order to terminate an employment contract represents an inovative, and in its own way, a unique, and legally defined way of terminating an employment contract. It is an institute on the basis of which a court can terminate an employment contract, thereby terminating an employment relationship between the parties of the contract. The decision of the court in the direction of terminating an employment contract with the use of its ruling represents a very complex process, consisting of a properly conducted evidentiary procedure, taking into account the claims, circumstances and interests of both contracting parties. The relationship between the reintegration of the employee and the termination of the employment contract based on the ruling of the court is also complex, as is the determination of financial compensation, which must be properly assessed within the limits of the law and must constitute adequate compensation in lieu of reintegration. This is a particularly interesting labour law institute because of the high degree of individuality of cases and the wide range of case-law. The use of a court ruling for termination of the employment contract also intersects with other labour law institutes. The master thesis is devoted to a statistical and content analysis of the case-law of the Higher labour and social court and the Supreme court of the Republic of Slovenia. The termination of the employment contract based on the ruling of the court is analysed seperately for each of the two courts, where it is further divided to the various relevant individual elements.
