Mandatory pension and disability insurance is a system that ensures social security for
insured persons. The work focuses on the analysis of the rights of insured persons
under the Pension and Disability Insurance Act (ZPIZ-2) and the procedures they must
undergo to exercise them. The procedures for obtaining a pension and disability benefit
are discussed, including the collection of documentation and submission of
applications to the Pension and Disability Insurance Institute of Slovenia (ZPIZ). The
research analyzes the legal frameworks that regulate these procedures, taking into
account the General Administrative Procedure Act (ZUP), the Labor and Social Courts
Act (ZDSS-1) and other relevant regulations. The compliance of the procedures with
the right to equal treatment and accessibility for all insured persons is examined.
Special emphasis is placed on key challenges in exercising rights, such as long waiting
times, the complexity of administrative procedures and limited access to information.
The empirical part presents findings on the shortcomings of the system and proposals
for improving procedures that would contribute to greater efficiency and fairness in
enforcing the rights of insured persons. The research contributes to the development
of a more efficient system of pension and disability insurance and to facilitating access
to rights for beneficiaries.
