Online public auction is the main way of selling real estate in enforcement proceedings. The sale of real estate by online auction is carried out on the basis of the conditions set by the court in the order for sale. The key conditions are the determination of the starting price, the step of sales process, the amount of the security deposit, the deadline for depositing the purchase price, and the time of the start of the auction and its duration. Everyone who has paid the security deposit in time, or is exempt from paying it, can participate in the auction. Bidding takes place electronically on the sodnedrazbe.si portal. The course of the online auction can be divided into the first part, in which all registered bidders participate, and in which bids are raised, and into the second part, in which pre-emptors who have paid a deposit and joined the auction have the opportunity to match the highest bid. The bidder is bound by the bid they submitted and cannot cancel it. The first part of the online auction ends with the expiration of the time specified by the order for its duration, whereby this time is extended by an additional two minutes for each offer made less than two minutes before the end of the auction or its extension. The second part of the auction with pre-emptors will only take place if they have joined the auction. If one of them has exercised the right of pre-emption, the auction between him and the highest bidder continues at a special hearing in court. The special feature of the online auction is that the bidders are anonymous throughout the auction and cannot communicate with one another, which eliminates the possibility of unauthorized agreements and extortion, which occurred between physically present bidders at "classic" public auctions. The court will allocate the real estate to the highest bidder, and after the payment of the purchase price is paid on time, the real estate will also be delivered. Irregularities related to the course of the online auction can be claimed by bidders in an appeal against the decision to deliver the property to the buyer.
