The divorce process is already a complex and often lengthy court procedure, and if children are involved, it is complicated even further. One of the fundamental issues concerning children that must be resolved in both amicable and non consensual divorce proceedings is the childrens trust in their care and upbringing. The court has several options in making its decidion, it can entrust the children to the care and custody of one parent, it can entrust one parent with one child and the other parent with the other child, and the last option is to entrust the children to joint custody. In my Masters thesis, I will examine all the options, but I will focus in particular on joint custody, which, since the adoption of the 2017 Family Code, has been established as the primary choice. I will also present the childs right to express his or her opinion in divorce proceedings, which is the most important right of the child in these proceedings, as it actually allows the child to influence the final decision of the court. Throughout the Masters thesis, I will also demonstrate the importance of the involvement of different institutions in the divorce proceedings for the sake of the child.
