This master's thesis, shows the latest legislative trends in the legal regulation of artificial termination of pregnancy (hereinafter ATP), with a comparative legal analysis of the currently valid regulations governing the field of ATP around the world. Its central part illustrates in more detail the process of recent, high-impact legislative changes, and at the end, it focuses on some key open questions regarding ATP in Slovenia, which may affect possible future legislative changes in our country.
Part of the assignment is also dedicated to showing the importance of a holistic view of the legislative trends of the ATP, which, in contrast to observing only the legal aspect, also highlights the important influence of philosophical and moral positions, arguments and dilemmas. The latter frequently loom large in the search for justice that should balance the conflicting interests of the pregnant woman and the fetus, and sometimes even prevail over legal theoretical considerations.
