Throughout the history the process of getting a building permit has been known as a procedurally and substantially one of the most difficult administrative procedure. Due to the wide involvement of different industries, the building permit process requires the knowledge and cooperation of various experts in the construction, spatial and legal fields. Moreover the process is intertwining different, environmental and cultural aspects.
Building any kind of facilities is not left free to individuals in the legal system of the Republic of Slovenia. In order to protect the public interest, the area is regulated by the State. The primary regulation is in the Building Act, which is security-oriented legal act. This safeguards the safety of facilities and the principle of equal opportunities. To this end, it applies certain rules and procedures that may present an administrative barrier to the investor.
The master's thesis presents the procedures and main steps in the process of obtaining the building permit, their essential components and participants. It outlines the different types of building permits and their depending use on the type and purpose of the facility. In the end it defines possibilities for legalization of unauthorized facilities.
