Abstract
Postopek izdaje gradbenega dovoljenja je v svoji zgodovini slovel kot postopkovno in materialno težji upravni postopek. Zaradi vključenosti različnih panog zahteva znanje in sodelovanje gradbenih, prostorskih in pravnih strokovnjakov. Ob tem se prepletajo prostorski, okoljski, naravovarstveni in kulturnovarstveni vidiki. V pravnem sistemu Republike Slovenije gradnja ni prepuščena posameznikom. Področje je, z namenom zaščite javnega interesa, regulirano s strani države. Primarno je regulirano z Gradbenim zakonom, ki je varstveno naravnan. Varuje varnost objektov in spoštovanje načela enakih možnosti. V ta namen uveljavlja določena pravila in postopke, ki lahko bodočemu investitorju predstavljajo administrativno oviro. Magistrsko diplomsko delo podrobneje predstavi prenovljen postopek izdaje gradbenega dovoljenja, njegove bistvene sestavine in udeležence. Obrazloži pogojenost uporabe postopkovno različnih načinov pridobitve gradbenega dovoljenja glede na namen in vrsto objekta. Ter opredeli možne načine legalizacije nedovoljenih objektov, kot obliko naknadne pridobitve gradbenega dovoljenja za že zgrajene objekte.

Title:The procedure for a building permit under the new Building Act
Abstract:
Throughout the history the process of getting a building permit has been known as a procedurally and substantially one of the most difficult administrative procedure. Due to the wide involvement of different industries, the building permit process requires the knowledge and cooperation of various experts in the construction, spatial and legal fields. Moreover the process is intertwining different, environmental and cultural aspects. Building any kind of facilities is not left free to individuals in the legal system of the Republic of Slovenia. In order to protect the public interest, the area is regulated by the State. The primary regulation is in the Building Act, which is security-oriented legal act. This safeguards the safety of facilities and the principle of equal opportunities. To this end, it applies certain rules and procedures that may present an administrative barrier to the investor. The master's thesis presents the procedures and main steps in the process of obtaining the building permit, their essential components and participants. It outlines the different types of building permits and their depending use on the type and purpose of the facility. In the end it defines possibilities for legalization of unauthorized facilities.
