The purpose of the master's thesis is to present short-term (tourist) home rentals, which are nowadays in majority being rented through online short-term rental platforms. Online platforms have made short-term home rental business much easier, and on the other hand they have posed many challenges in the legislative field, as short-term rental housing has become much more widespread. Before that homes were being rented mostly by professionals, but with the start of such online platforms, this type of business became available to a wider audience, who see the possibility of additional income in this. However, this has also led to some negative effects that require adjustments in the legislative field.
In the first part of my master's thesis I will present online platforms for short-term home rentals, their business model and the standpoint of The Court of Justice of the European Union on those platforms. In the continuation of my master's thesis I will present the legislation on short-term housing in the selected EU Member States, and in particular how such activity is regulated in the capital cities of selected countries where short-term home rentals are most widespread, since tourists tend to visit capital cities the most. I will also describe the legislative regulation of short-term housing in Slovenia and the problems of the existing regulation. In the last part of the master's thesis I will turn to the draft of the new Slovenian housing law, more specifically to the article which is supposed to introduce certain changes in the field of short-term housing. I will define the proposed amendments, and present possible solutions in the field of short-term housing.
