The master’s thesis titled “THE RESTRUCTURING OF SMALL COMPANIES UNDER SLOVENIAN INSOLVENCY LEGISLATION” represents the result of endeavors to depict past and current legislative instruments of restructuring of small companies, aiming at achieving short-term and long-term solvency of those companies and preventing bankruptcy as a last resort response to insolvency.
In the third chapter, following the intruductory portion of the thesis, I offer a detailed description of the substantive and procedural aspects of the procedures which had been available for small companises pursuant to the Slovenian Financial Operations, Insolvency Proceedings, and Compulsury Dissolution Act (ZFPPIPP) from its entering into force.
The thesis is concluded with the fourth chapter containing a comparison of the three financial restructuring procedures of small companies based on legal provisions, case-law and past procedures, followed by critical comments on the adequacy of present legal provisions and the dubious legislative changes enacted by ZFPPIPP-G.
