Izvleček
V magistrskem delu je obravnavana pravica dostopa do informacij javnega znacaja, ki je v vsem svetu vedno bolj razširjena in obravnavana kot temeljna clovekova pravica. Vedno vec drţav v svetu ima pravico zapisano v ustavi, natancnejšo ureditev pa v zakonih, kjer prosilcem zagotavljajo pravico v vecjem obsegu, kot jo zagotavlja Evropska konvencija o clovekovih pravicah. Vsem zakonom je skupno, da dolocajo krog zavezancev, ki so dolţni posredovati informacije, ter izjeme od prostega dostopa. Ne glede na zakonsko ureditev podrocja je ucinkovitost zakona odvisna od tega, kako se pravica in odlocanje zavezancev izvajata. Namen zakonske ureditve podrocja v vseh drţavah je zagotoviti javnost in transparentnost delovanja javnih organov in omogociti enako uresnicevanje pravice vsem fizicnim in pravnim osebam, da zahtevane informacije pridobijo. Iz empiricne raziskave pravice dostopa do informacij javnega znacaja pri delu Sodnega sveta ugotavljam, da organ o zahtevah prosilcev odloca pravocasno in skladno z veljavno zakonodajo. Podatki, pridobljeni v raziskavi, kaţejo na to, da prosilci premalo poznajo pristojnosti organa, saj zahtevajo tudi informacije, ki ne izhajajo iz njegove pristojnosti, kar se izkazuje predvsem v vecjem številu zavrnjenih zahtev. Menim, da je teţava predvsem v tem, da so bile pristojnosti do nedavnega urejene v vec zakonih. Na osnovi empiricne in primerjalne analize, ki sta bili osnova za potrditev oziroma ovrţenje hipotez, ugotavljam, da so vse hipoteze potrjene. Kot najpomembnejšo izpostavljam, da Sodni svet pri izvajanju ZDIJZ dosledno upošteva Zakon o splošnem upravnem postopku.

Naslov:ANALYSIS OF EXERCISING THE RIGHT TO PUBLIC INFORMATION IN THE FUNCTIONING OF THE JUDICIAL COUNCIL

This master’s thesis discusses the right to access public information, which is becoming more and more widespread around the world and treated as a basic human right. A growing number of world countries have included this right in their constitution and have regulated it more precisely in acts which ensure this right to applicants to a greater extent than that ensured by the European Convention on Human Rights. What all of the acts have in common is that they specify the circle of entities that are obligated to disclose information, and exceptions to free access. Regardless of the field’s statutory regulation, an act’s efficiency depends on how these entities implement this right and decision making. The purpose of legally regulating this field in all countries is to ensure public and transparent operation of public bodies, and to enable all natural and legal entities equal fulfilment of the right to obtain the requested information. Empirical research into the right to access public information in the operation of the Judicial Council has ascertained that the body decides requests from applicants in good time and in compliance with the legislation in force. The data obtained under this research indicate that applicants are insufficiently familiar with the body’s jurisdictions because they also request information that goes beyond its jurisdiction, which is evident above all in a higher number of denied requests. In my opinion the main problem is that until recently such jurisdictions were regulated by several acts. Based on the empirical and comparative analysis, which were the basis for confirming or rejecting hypotheses, it has been established that all of the hypotheses have been confirmed. The most important hypothesis being that when implementing the Public Information Access Act, the Judicial Council consistently follows the General Administrative Procedure Act.
