Billboards, advertising and information facilities, present in the roadside area and thus also in narrow field of vision of drivers, interrupt the concentration of drivers and affect the driving skills of the driver. With distraction away from driving they cause the confusion and consequently weaken or slow reaction times and responses of driver so that they are not fully aware of the potential traffic hazards. The solution is to search for a single normative regulation that will deal with the relationship between advertising and road safety in a manner of a single regulation act (advertising law), which is currently still the victim of a conflict of interest between safety and profitability.
However, this is not the only aspect of even more complex issues, which, according to the results of the research carried out, stems from the lack of political will to complete the chaotic situation and the arbitrariness and inactivity of local authorities, which can not be controlled solely by inspection and which is also one of the most important emphasis on the Master's thesis.
Inspection by deciding on measures based on an inadequate legal basis or without the latter can not be a way for the planned and selective cleansing of the road, nor for the mediation in the conflict of safety and profit, and especially when the roads are privately owned, despite the clear and uniform case-law of the Constitutional Court of the Republic of Slovenia.
The Master's thesis deals with the discussion of the presence of legal procedural dilemmas of inspection supervision in direct practice and its actual limitations through inheritance and authorizations, but where we do not yet have the relevant constitutional case-law.
In the Master's thesis, the depictions of the studied state and analysis of the research through the legislative provisions of the material regulations, the limited competences and powers of municipal road inspectors and the case law, in the wish that the tab on the balance will ultimately be transferred to the side of the rule of law, traffic safety and natural environment.
