Diplomsko delo se ukvarja s problematiko prijave nasilja v družini s strani tretjih oseb. Kot se je izkazalo med raziskovanjem in pisanjem diplomske naloge, gre za precej neraziskano področje. Mnogi avtorji (Dobnikar, Filipčič, Felson, Zaviršek in nekateri drugi), ki so predstavljeni tudi v nadaljevanju, se namreč ukvarjajo predvsem z razlogi, ki jih navajajo žrtve in pomembno vplivajo na to, da le-te ostajajo v nasilnem odnosu in ne prijavijo nasilja v družini. Manj pa je zapisanega o tretjih osebah, ki vedo za nasilje v družini in ga ne prijavijo, ter o njihovih razlogih za takšno ravnanje. Teoretični del te diplomske naloge v začetku obravnava družino kot skupnost, ki jo zaznamuje na eni strani varnost, na drugi pa nevarnost, kar odražajo tudi statistični podatki o nasilju v družini. Glede na pojavnost nasilja v družini pa naloga spregovori tudi o družbenosti tega problema. Ker je nasilje v družini seveda prisotno tudi v slovenskem prostoru, je posebno poglavje namenjeno prav pregledu stanja nasilja v družini pri nas, v nadaljevanju pa slovenski zakonodaji, ki se ukvarja z nasiljem v družini. Za konec so predstavljeni še različni odzivi na nasilje v družini, predvsem s strani žrtev nasilja in pa tudi tretjih oseb, ki vedo za nasilje v družini, pa ga ne prijavijo. V procesu raziskovanja sem spoznala, da so tretje osebe, ki vedo za nasilje v družini in molčijo, ter njihovi razlogi za molk precej zapostavljeni. Prav zaradi tega želi empirični del naloge odgovoriti na vprašanje, ki ga izpostavlja že sam naslov: ali je prijava nasilja v družini res tako enostavna stvar. Odgovor je mogoče najti v treh različnih intervjujih, prav skoznje pa se odraža širina tega problema. Povabilu za sodelovanje so se namreč odzvale tri osebe, ki so se znašle ali pa še vedno nastopajo v različnih »vlogah«, ko govorimo o nasilju v družini: tretja oseba, ki je prijavila nasilje v družini, tretja oseba, ki ve za nasilje v družini, pa ga ne prijavi, in žrtev nasilja v družini, ki nasilja ne prijavi. Razloge za molk, ki jih navajajo, so zelo različni, nekateri so skupni vsem, drugi so značilni le za eno od njih. Celostno gledano je vsem trem skupen enak odgovor na vprašanje, ki ga izpostavlja diplomska naloga, hkrati pa je to tudi ključna ugotovitev: prijava nasilja v družini ni enostavna stvar.

Reporting domestic violence – is it really so easy?

The thesis deals with the issues of reporting domestic violence by third parties. As it turned out during the research and writing the thesis, it is a considerably uncharted field. Many authors (Dobnikar, Filipčič, Felson, Zaviršek and some others), also presented below, are mainly dealing with the reasons quoted by victims. They have a significant impact on the fact the victims remain in a violent relationship and don’t report domestic violence. Less is written about the third parties being aware of domestic violence and not reporting it, and their reasons for doing so. The theoretical part of this thesis initially discusses family as a community, on one side characterized by security and on the other by danger, what is reflected in the statistics on domestic violence. Considering the occurrence of domestic violence, the thesis also speaks about the sociality of this problem. Since domestic violence is certainly also present in the Slovenian space, a special section is dedicated precisely to review the situation of domestic violence in our country. Following is the review of Slovenian legislation which deals with domestic violence. In conclusion, different responses to domestic violence are presented, especially by the victims of such violence and also by the third parties being ignorant of domestic violence by not reporting it to the authorities. In the process of research I have come to conclusion that the third parties who are aware of domestic violence but remain silent, and their reasons for silence, are rather neglected. For this reason, the empirical part of the thesis wants to answer the question focused upon the title itself: Is reporting domestic violence really such a simple thing. The answer can be found in three different interviews that showing the broadness of this matter. Three individuals who found themselves or they still appear in different “roles” when talking about domestic violence responded to the invitation to participate: a third party who reported domestic violence to authorities, a third party who acknowledges domestic violence but refuses to report it, and a domestic violence victim who doesn’t report the violence. The reasons for silence stated by interviewees are very different. Some are common to all, whereas others are specific to just one of them. Generally, the three participants share the same answer to the question focused upon in the thesis and is at the same time the key consideration: reporting of domestic violence is not a simple thing.
