PROCESS ANALYSIS OF A BUILDING PERMIT
The issuance of a building permit is an administrative procedure. The competent authority for issuance is the administrative unit in the area where the building is located, except in the case of objects of national importance and objects with environmental impacts, where the ministry is responsible for issuing the building permit. The application for a building permit is submitted by the investor. The purpose of my thesis is to present the process of issuing a building permit, the phases of the procedures, changes in sectoral legislation, practical challenges, and trends in the issuance of building permits.
In my thesis, I employed the normative method, analysis of professional literature, and the descriptive method to analyze the process of issuing a building permit. Historical, sociological, axiological, dogmatic, inductive, and deductive methods were used in the analysis of literature and legal provisions. Historical and comparative analyses were used for the first hypothesis, examining the new legislation on the issuance of building permits compared to the previous one. A comparative method was used to verify the second hypothesis, as a comparison of building permits issued for the years 2018, 2019, and 2020 was made.
Based on professional literature and a comparison of regulations, especially ZGO-1, GZ, and the current GZ-1, I have come to the conclusion that the new law has addressed some of the previous shortcomings and aims to simplify and increase the efficiency of procedures, although it also introduces new controversial provisions. In the empirical part, I found that the number of issued building permits during the period from 2018 to 2020 has decreased, but these are small differences, so the stability of investment intentions and the number of procedures remains relatively stable regardless of changes in regulations.
