Izvleček
Izdaja gradbenega dovoljenja je upravni postopek. Za izdajo je pristojna upravna enota na območju, katerem se nahaja objekt, razen kadar gre za objekte državnega pomena in objekte z vplivi na okolje, takrat je za izdajo gradbenega dovoljenja pristojno ministrstvo. Vlogo za izdajo gradbenega dovoljenja vloži investitor. Namen diplomskega dela je predstaviti postopek izdaje gradbenega dovoljenja, faze postopkov, spreminjanje področne zakonodaje, težave v praksi in trende obsega izdaje gradbenega dovoljenja. V diplomskem delu sem za analizo postopka izdaje gradbenega dovoljenja uporabila normativno metodo, analizo strokovne literature in metodo deskripcije. Pri analizi literature in zakonskih določil je bila uporabljena zgodovinska, sociološka, aksiološka, dogmatska ter induktivna in deduktivna metoda. Pri prvi hipotezi sta bili uporabljeni zgodovinska in primerjalna analiza, preučena je bila nova zakonodaja o izdaji gradbenega dovoljenja glede na prejšnji. Za preverjanje druge hipoteze, je bila uporabljena primerjalna metoda, saj je bila narejena primerjava izdaj gradbenega dovoljenja v letih 2018, 2019 in 2020. S pomočjo strokovne literature in primerjave predpisov, zlasti ZGO-1, GZ in veljavnega GZ-1, sem prišla do ugotovitve, da je nov zakon odpravil nekaj prejšnjih pomanjkljivosti in da stremi k poenostavitvi in večji učinkovitosti postopkov, čeprav hkrati uvaja nove sporne določbe. V empiričnem delu sem ugotovila, da je število izdanih gradbenih dovoljenj v obravnavnem obdobju od leta 2018 do leta 2020 upadlo, a gre za majhne razlike, torej je stabilnost investicijskih namer in število postopkov razmeroma ustaljeno ne glede na spremembe predpisov.

PROCESS ANALYSIS OF A BUILDING PERMIT The issuance of a building permit is an administrative procedure. The competent authority for issuance is the administrative unit in the area where the building is located, except in the case of objects of national importance and objects with environmental impacts, where the ministry is responsible for issuing the building permit. The application for a building permit is submitted by the investor. The purpose of my thesis is to present the process of issuing a building permit, the phases of the procedures, changes in sectoral legislation, practical challenges, and trends in the issuance of building permits. In my thesis, I employed the normative method, analysis of professional literature, and the descriptive method to analyze the process of issuing a building permit. Historical, sociological, axiological, dogmatic, inductive, and deductive methods were used in the analysis of literature and legal provisions. Historical and comparative analyses were used for the first hypothesis, examining the new legislation on the issuance of building permits compared to the previous one. A comparative method was used to verify the second hypothesis, as a comparison of building permits issued for the years 2018, 2019, and 2020 was made. Based on professional literature and a comparison of regulations, especially ZGO-1, GZ, and the current GZ-1, I have come to the conclusion that the new law has addressed some of the previous shortcomings and aims to simplify and increase the efficiency of procedures, although it also introduces new controversial provisions. In the empirical part, I found that the number of issued building permits during the period from 2018 to 2020 has decreased, but these are small differences, so the stability of investment intentions and the number of procedures remains relatively stable regardless of changes in regulations.
