This master's thesis deals with the prohibition of discrimination on the grounds of political opinion. It begins by presenting the basics of anti-discrimination law to the extent necessary for the purposes of the master's thesis. It then analyses the translation of relevant concepts from international legal sources. A special chapter is devoted to identifying the meaning of the concepts of 'opinion' and 'political opinion' and the possible application of the findings in the field of asylum law with regard to political opinion also to the field of anti-discrimination law. The main chapter focuses on the historical background of the personal characteristic of political opinion, developments in international sources, comparative law aspects, the Slovenian legislation and the practice of the relevant authorities. It then presents the relationship to the personal characteristic of belief and totalitarian political opinion as a specific type of political opinions. In the final part, the main findings of the master's thesis are presented.
Political opinion as a personal characteristic has been included in the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and the European Convention on Human Rights. However, research quickly reveals that most countries do not provide for a prohibition of discrimination on the grounds of political opinion. For example, the prohibition of discrimination on the grounds of political opinion is not included on the legislative level in Slovenia, while it is still guaranteed at the constitutional level and in international treaties binding Slovenia.
