Home Work is an autonomous labour law institute which today presents itself as a necessity, a need and a reality. The increased interest of employers in the Home Work was demonstrated in 2020, with the organisation of Home Work being the result of the country`s epidemiological situation and the recommendations of the medical profession rather than the advance decision of employers in this way of working. Experience has shown that work from home produces many positive effects, but the current legislative framework has proved rigid and vague in many aspects. The latter has already prompted calls for changes to the regulation and the first steps have already been taken towards drafting legislative changes, as the Economic and Social Council has set up a working group to prepare amendments to the law. In the future, it is expected that the possibility of regulating Home Work with annex to the employment contract will be regulated in detail, the right to »disconnect« will be regulated, a combined hybrid model will be regulated in practice, and that changes in the regulation of Home Work will be primarily subject to collective bargain. It should also be noted that Home Work will no longer only be the subject of an agreement by the parties, but under Directive (EU) 2019/1158 of the European Parliament and of the Council on work-life balance for parents and carers and repealing Council Directive 2010/18/EU, the worker will have the right, under certain conditions, to carry out his work remotely. The master`s thesis focuses on the current problem of Home Work, trying to offer solutions to make it as accessible as possible to employers and employees of the widest range of activities.
