Abstract
Delo na domu je avtonomen delovnopravni institut, ki se danes kaže kot nuja, potreba in realnost. Povečan interes delodajalcev za opravljanje dela delavcev na domu se je pokazal v letu 2020, pri čemer je bilo organiziranje dela na domu posledica epidemioloških razmer v državi in priporočil medicinske stroke in ne vnaprejšnje odločitve delodajalcev za takšen način dela. Izkušnje so pokazale, da delo na domu prinaša veliko pozitivnih učinkov, kljub temu pa se je trenutni zakonodajni okvir izkazal kot tog in v več pogledih nejasen. Zaradi slednjega je gospodarstvo že pričelo pozivati k spremembam pravne ureditve, prav tako so že bili storjeni prvi koraki v smeri priprave zakonodajnih sprememb. Ekonomsko socialni svet je namreč že oblikoval delovno skupino, katere naloga je priprava sprememb zakona. V prihodnosti velja pričakovati, da se bo uredila predvsem možnost urejanja dela na domu z aneksom k pogodbi o zaposlitvi, da se bodo podrobneje uredile obveznosti v zvezi z zagotavljanjem varnosti in zdravja pri delu, določila pravica do »odklopa«, v praksi zaživel kombinirani oz. hibridni model dela ter da bodo spremembe na področju regulacije dela na domu predvsem predmet kolektivnega dogovarjanja. Omeniti velja tudi, da delo na domu ne bo več le predmet dogovora pogodbenih strank, temveč bo imel delavec skladno z Direktivo 2019/1158 o usklajevanju poklicnega in zasebnega življenja staršev in oskrbovalcev pod določenimi pogoji pravico, da svoje delo opravlja na daljavo. Magistrsko diplomsko delo se osredotoča na aktualno problematiko dela na domu, pri tem pa poskuša ponuditi rešitve, da bi delo na domu postalo čim bolj dostopno delodajalcem in delavcem najširšega spektra dejavnosti.

Title:Legal aspects of Home Work
Abstract:
Home Work is an autonomous labour law institute which today presents itself as a necessity, a need and a reality. The increased interest of employers in the Home Work was demonstrated in 2020, with the organisation of Home Work being the result of the country`s epidemiological situation and the recommendations of the medical profession rather than the advance decision of employers in this way of working. Experience has shown that work from home produces many positive effects, but the current legislative framework has proved rigid and vague in many aspects. The latter has already prompted calls for changes to the regulation and the first steps have already been taken towards drafting legislative changes, as the Economic and Social Council has set up a working group to prepare amendments to the law. In the future, it is expected that the possibility of regulating Home Work with annex to the employment contract will be regulated in detail, the right to »disconnect« will be regulated, a combined hybrid model will be regulated in practice, and that changes in the regulation of Home Work will be primarily subject to collective bargain. It should also be noted that Home Work will no longer only be the subject of an agreement by the parties, but under Directive (EU) 2019/1158 of the European Parliament and of the Council on work-life balance for parents and carers and repealing Council Directive 2010/18/EU, the worker will have the right, under certain conditions, to carry out his work remotely. The master`s thesis focuses on the current problem of Home Work, trying to offer solutions to make it as accessible as possible to employers and employees of the widest range of activities.
