In the specific master's thesis, I dedicate myself to the moral and legal analysis of the concept of "illegality" of migration. The latter leads me to six key final findings that justify the incorrect or at least inappropriate use of the term “illegality” when dealing with migration. The label "illegal" underlies the encroachment on the dignity of persons, causes severe negative consequences in the treatment of individuals and thus violations of fundamental human rights. It also provides an apparent excuse for criminalization, including the actions of refugees and asylum seekers. I conclude my master's thesis with the views of various legal philosophers on the right to have rights and the right to rebel, which further supports the position on the inappropriateness of the concept of "illegality" of migration. The European "fight" is presented with an emphasis on the Slovenian "fight" against "illegal" migrations, and finally also possible solutions with an emphasis on the introduction of a mandatory humanitarian visa.
