Presenteeism as a relatively new concept with a still emerging definition and already increasingly prevalent in work environments significantly endangering the health of employees and organisation as a whole. Up to today researches have primarily considered presenteeism for its financial impact and for its emerging reasons that can be attributed to both the individual and the organisation. Master thesis therefore analyse and systematically describe the presenteeism phenomena, positioning it in a modern working environments, searching for connections and relations between specific legal institutes and presenteeism. Even a brief review of the legislation has shown that legislation determines sufficient legal framework as both the state and the employer are obliged to ensure safety and health in work environments. Employee is enabled to take sick leave, sick pay is provided and the reasons for employment termination must always be legitimate and justified. Due to the key finding of the thesis that social and labour relations in organisations are the one putting a greater pressure on employees, than any implementation of legal norms as such, is therefore extremely important to adopt an interdisciplinary perspective of presenteeism, especially from the work health and safety point of view. Emphasis must be given to the promotion of health in the work environment and assessing the risk of its occurrence, which must be based on actual psychological risks and an ongoing assessment of the effects of legal provisions. Research findings could potentially refer legislators to adopt legally framed requirement to monitor and measure presenteeism, and to adopt, implement and to evaluate plans for a reduction of negative consequences of presenteeism.
