Abstract
Uber je ameriško tehnološko podjetje, ki je razvilo istoimensko aplikacijo, preko katere se povežeta potnik in voznik – zasebnik, ki mu za opravljanje vožnje ni potrebno pridobiti nikakršnih licenc. Aplikacija potniku predlaga voznika, ki mu je, glede na podatke GPS, najbližje. V letu 2016 je Slovenija podpisala pismo o nameri, s katerim je Uberju dala možnost vstopa na slovenski trg. Delovno pravo je samostojna pravna panoga, njegov glavni namen pa je varstvo delavca, ki predstavlja šibkejši člen v odnosu do delodajalca. Magistrsko diplomsko delo z naslovom Uber v luči delovnega prava tako na eni strani zajema bistvene značilnosti storitev, ki jih nudi Uber, pomembne sodne odločitve s strani londonskega sodišča in Sodišča Evropske unije, iz katerih izhaja, da gre za storitve na področju prevoza, na drugi strani pa se dotika opredelitve delavca, delodajalca in delovnega razmerja. Definicije so podkrepljene s slovensko sodno prakso, iz katere izhaja, da sta bistvena elementa delovnega razmerja opravljanje nepretrganega dela po navodilih in pod nadzorom delodajalca. Namen naloge je prikazati, da se v modelu sodelovalnega gospodarstva, po principu katerega deluje tudi Uber, napačno sklepa preveč pogodb civilnega prava, saj v večini primerov obstojijo elementi delovnega razmerja, ki zahtevajo sklenitev pogodbe o zaposlitvi.

Title:Uber in the Light of Labour Law
Abstract:
Uber is an American technological company which developed a mobile app that links passengers to drivers – private persons who are not required to hold any licences for the provision of driving services. Based on the GPS data, the driver currently situated closest to them is suggested to a passenger by the app. In 2016, Slovenia signed a letter of intent allowing Uber the opportunity to enter the Slovene market. Labour law is an independent branch of law, its main purpose being to protect the employees, who are the weaker party in an employment relationship. The master thesis entitled ʻUber in the Light of Labour Lawʼ thus, on the one hand, covers the typical features of the services provided by Uber and the significant court decisions passed by the courts in London and the Court of Justice of the European Union which imply that essentially these are transportation services; on the other hand, the thesis also explores the definitions of an employee, employer and employment relationship. The definitions are supported with examples from the Slovene case law which imply that the material element of an employment relationship is the provision of continuous work in accordance with the instructions and under the supervision of an employer. The aim of the thesis is to show that civil law contracts are frequently wrongfully used in the collaborative economy models, which is the model also used by Uber, as in most cases elements of an employment relationship exist, which call for employment contracts.
