Izzivi delovnega prava v dobi sodelovalnega gospodarstva

Izvleček
Magistrska naloga je omejena na preučevanje vprašanj, ki so se zaradi vzpona sodelovalnega gospodarstva pojavila na delovnopravnem področju. Namen naloge je bil prikazati problematiko položaja delavcev, ki jih prinaša sodelovalno gospodarstvo ter uporaba spletnih platform za posredovanje dela. Fleksibilnost opravljanja dela, ki jo nudijo spletne platforme, namreč lahko nudi nezaposlenim osebam možnost zaslužka, zaposlenim ponuja dodaten zaslužek, odpira več možnosti samozaposlenim osebam glede izbire delovnega časa in izbire delodajalca, ponuja tudi možnost dodatnega zaslužka ostalim skupinam kot so študenti, starši na porodniškem dopustu in upokojenci, predvsem pa odpira vrata širši globalni ponudbi dela. Hkrati pojav sodelovalnega gospodarstva in delo preko spletnih platform odpira probleme na področju delovnega časa, plačila, zdravja in socialnih pravic ter kolektivnih pravic delavcev in razširitve prekarnosti in informacijske asimetrije delovnih razmerij. Delavci, ki opravljajo delo preko spletnih platform, se po vsem svetu soočajo z izzivi kako opisati in pod katero obliko subsumirati njihovo razmerje z delodajalci, saj se zaradi razvoja tehnologije in novih oblik dela le-te ne ujemajo več s tradicionalnimi opredelitvami razmerja. Nekaterim udeležencem na trgu bi moralo, zaradi narave in okoliščin dela, ki ga opravljajo, pripadati delovnopravno varstvo vendar meja med opredelitvijo nekega razmerja kot delovno ali pa kot pogodbeno razmerje s samozaposlenim delavcem ni več jasna. Predstaviti poskušam različne načine razmejitve med odvisnim delavcem in neodvisno samozaposleno osebo ter ostale načine urejanja in pripisovanja delovnopravnega varstva kot je uvedba kategorije ekonomsko odvisne osebe ter funkcionalni koncept delodajalca.

Naslov:The challenges of labor law in an age of a collaborative economy

The master's thesis is limited to examining issues that have emerged in the area of labor law due to the rise of the collaborative economy. The purpose of this thesis was to present the problems of the position of workers brought by the collaborative economy and the use of online platforms for providing work. The flexibility of work offered by online platforms can offer unemployed people the opportunity to earn money, offer employees extra income, open more opportunities for self-employed people to choose working hours and their employers, and also offer the possibility of additional income to other groups such as students, parents on maternity leave and seniors, and above all opens the door to a wider global job offer. At the same time, the emergence of a collaborative economy and work through online platforms raises problems in the areas of working time, pay, health and social rights and collective rights of workers, and the extension of precariousness and information asymmetry in working relationships. Workers all over the world that are working through online platforms face the challenge of how to describe and subsume their relationship with employers, as technology and new forms of work no longer correspond with traditional definitions of employment relationships. Some market participants, owing to the nature and circumstances of the work they do, should be entitled to labor protection, but the boundary between defining a relationship as an employment or as a contractual relationship with a self-employed worker is no longer clear. I am trying to present different ways of distinguishing between a dependent worker and an independent self-employed person, as well as other ways of regulating and attributing employment protection, such as introducing the category of economically dependent person and the functional concept of an employer.
