Posebnosti pogodb o naročilu umetniških likovnih del

Pogodba o naročilu umetniškega likovnega dela je pravni posel, s katerim se avtor zaveže ustvariti likovno delo in njegov izvirnik izročiti naročniku, ta pa mu bo za to plačal honorar. Razlikovati moramo med enostavnimi pogodbami, kjer avtor obdrži avtorsko pravico v celoti, ter zloženimi, kjer se zaveže še k prenosu posameznih materialnih avtorskih ali drugih pravic. Njena ločena obravnava je utemeljena s posebnimi lastnostmi pogodbenega predmeta, naravo razmerja in varstvom avtorja, ki imajo obligacijskopravne, avtorskopravne in tudi stvarnopravne posledice.

• Title: Specificities of the Contract to Comission an Artwork

Abstract

Contract to Comission an Artwork is transaction by which the author undertakes to create the work of art and to deliver the original to another contracting authority in return for payment, which can be arranged as fee, royalty or remuneration. It is crucial to distinguish contracts where author retains copyright as a whole, from contracts that include the transfer of an individualised copyright or related right. Seperate treatment of the Contract is justified by specificities which arise from characteristics of an artwork, nature of the contractual relationship and copyright protection, which have consequences in the area of the contract, copyright and property law.
