Contract to Comission an Artwork is transaction by which the author undertakes to create the work of art and to deliver the original to another contracting authority in return for payment, which can be arranged as fee, royalty or remuneration. It is crucial to distinguish contracts where author retains copyright as a whole, from contracts that include the transfer of an individualised copyright or related right. Seperate treatment of the Contract is justified by specificities which arise from characteristics of an artwork, nature of the contractual relationship and copyright protection, which have consequences in the area of the contract, copyright and property law.
