Abstract
Šport izhaja iz človekove biti in s športnim udejstvovanjem človek ustvarja specifičen svet. Eden od ciljev športnega prava je oziroma bi moral biti tudi varovanje človekovih pravic, ki pripadajo vsem ljudem. Šport je eden najboljših ambasadorjev človekovih pravic, vendar so pravice športnikov neraziskano področje, kjer še vedno obstaja vrzel med želenimi rezultati in športnikovimi pravicami ter svoboščinami. V teoriji so se razvile različne možnosti reševanja oziroma razreševanja sporov, tako kogentnih kot avtonomnih. Jedro naloge predstavlja pregled sodne prakse Evropskega sodišča za človekove pravice. Delo je zastavljeno v luči specifičnosti športa, ki povzroča široko polje možnih kršitev človekovih pravic. Nadalje obravnavam tudi morebitno prihodnost športne tematike pred ESČP, z ozirom na verjetnost obravnave pred sodiščem. Tako pravo kot šport sta del našega življenja in športa brez prava ni.

Title:Sport and ECHR
Abstract:
Sport is derived from the human nature and with sporting activity man creates a specific world. One of the goals of sports law is or should be the protection of human rights that belong to all people. Sport is one of the best human rights ambassadors, but athlete's rights are an unexplored field where there is still a gap between the desired results and athlete's rights and freedoms. In theory, various options for resolving disputes, both peremptory and autonomous, have been developed. The main body of my thesis is an overview of the case law of the European Court of Human Rights. The work is set in the light of the specificity of the sport, which causes a wide range of possible violations of human rights. I further examine the possible future of this topic before the ECtHR, in view of the likelihood of a hearing before the court. Both law and sport are part of our lives and there is no sport without law.
