Abstract
Namen magistrskega dela je analizirati pravno podlago oziroma zakone na področju avtorskih pravic s poudarkom na fotografiji, na kratko analizirati zgodovino sprememb na področju avtorskih pravic na ozemlju Republike Slovenije ter definirati glavne pojme, ki so potrebni za razumevanje le-teh. Sledi pregled pogojev, ki jim je treba zadostiti, da se nekaj šteje kot avtorsko delo, ter definiranje avtorske fotografije. V eksperimentalnem delu je predstavljeno zdajšnje stanje avtorskih pravic fotografov glede na razvitost svetovnega spleta, pregled in razlaga pogojev pri objavljanju fotografij na socialnih omrežjih ter spletnih straneh, na katerih se prodajajo licence fotografij, pregled kršitev avtorskih pravic s strani medijev ter razlaga primerov kršitev in predstavitev možnosti varovanja avtorskih fotografij. Predstavljeni so tudi nekateri znani primeri kršitev avtorskih pravic širom po svetu. Na podlagi raziskanega je bilo ugotovljeno, da se število kršitev avtorskih pravic s porastom spleta veča, ob tem pa se pojavljajo tudi novi načini za izboljšanje. Ob analizi teorije o avtorskih pravicah je bilo ugotovljeno, da je avtorsko delo pravno zaščiteno od trenutka nastanka oziroma objave, moralnih pravic avtor ne more prodati ali preložiti na koga drugega. Prav tako je bilo ugotovljeno, da se ob objavi fotografij na socialnih omrežjih avtor ne odreče avtorskim pravicam. Ugotovili smo tudi, na kakšen način in pod katerimi licencami je možno prodajati avtorske fotografije na spletnih straneh s stock fotografijami, ter da se vsaka nastala fotografija ne šteje nujno za avtorsko delo. Da bi fotografiji lahko pripisali izraz avtorska, mora izpolnjevati točno določene pogoje, navedene v ZASP.

Title:Photographers copyrights and the media's attitude towards their work
Abstract:
The purpose of this masters thesis is to analyze the legal part and laws concerning copyrights focusing on photography, a brief look at the history of copyrights in the Slovenian territory and the changes made in the last hundred years and also explaining the main terms needed to understant copyrights. The above is followed by defining the terms of photographs being considered as copyrighted material. The experimental part also reviews the current state of photographers copyrights considering the advancement of the internet, a brief look at the terms and conditions of social media sites, stock photography sites and their licences, followed by a look at some of the more known copyright infringement cases and a view at copyright infringement through media. Through the research in this theses, it has been found, that the number of copyright infringements is increasing with the growth of the internet but there are also more ways to improve this state. While analyzing the theoretical information on copyright, it was found that the copyrighted work is legally protected from the moment of its creation or publication, the author can not sell or give their moral rights to anyone else. It was also found that when publishing photos on social networks, the author does not waive their copyrights. We have also found out in what manner and under what licenses it is possible to sell copyrighted photos on stock photography sites and that any photograph created is not necessarily considered as copyrighted work, it must fulfill certain legal requirements.
