Abstract
Ureditev skupnega varstva in vzgoje v slovenskem pravnem redu se razlikuje od evropskih ureditev. Preko svoje magistrske naloge bom skušala ugotoviti ali je uvedba skupnega varstva in vzgoje kot pravila v naš pravni red smiselna, kateri so argumenti za in proti in zakaj sta skupno varstvo in vzgoja boljša oziroma slabša za otrokovo korist. Na začetku se bom posvetila temeljnemu načelu koristi otroka, kateremu sodišče sledi pri odločanju. V nadaljevanju bo poudarek na oblikah skupnega varstva in vzgoje ter obliki, ki je po mojem mnenju najprimernejša, izvrševanju roditeljske pravice in primerjalno pravni ureditvi po Evropi in po svetu. Celotno teorijo bom ponazorila s primeri iz sodne prakse ter se v zaključku opredelila do uvedbe skupnega varstva in vzgoje kot pravila.

Title:Shared custody as a rule
Abstract:
The regulation regarding shared custody in the Slovenian legal system differs from the European ones. This paper deals with the purpose of introducing shared custody as a rule in the Slovenian legal system, its advantages and disadvantages and its benefits for the child. The first part of this paper is dedicated to the principle of “the best interest of a child”, which must be respected when deciding in court. Furthermore, this paper presents the forms of shared custody, which, in my opinion, is the appropriate one, the execution of parental responsibility and legal comparative regulation in Europe and around the world. The entire theoretical part of the paper is illustrated with case law and the conclusion consists of my opinion on introduction of shared custody as a rule.
