Abstract
Agresivnosti in nasilništva se v današnji družbi bojimo boji in ju na vsak način poskušamo preprečiti. Tega se lahko najbolj učinkovito lotimo, če vemo, zakaj do agresivnosti sploh prihaja. Psihološke teorije vzrokov agresivnega vedenja kot vzroke pojmujejo notranje dejavnike, zunanje dejavnike, ali pa vzajemni vpliv obojih. Vsaka od teorij se osredotoča predvsem na enega od vzrokov, vendar pa lahko agresivno vedenje najbolj celovito pojasnimo prav z upoštevanjem vseh. Posameznik je namreč celota telesa, duše in duha in nemogoče bi bilo kar a priori izključiti vpliv misli ali čustev na posameznikovo vedenje. Razumevanje, zakaj do agresivnega vedenja prihaja, nam lahko pomaga tudi pri strokovnemu delu s tistimi, ki so se že vedli agresivno in so bili za to celo obsojeni, pa želimo njihovo ponavljanje agresivnega vedenja, torej povratništvo, preprečiti. Pri tam so nam v pomoč lahko psihološki testi za napovedovanje povratništva, ki so namenjeni predvsem temu, da se z visoko stopnjo verjetnosti predvidi, kateri storilci kaznivih dejanj bodo v kratkem času znova ponovili nasilno kaznivo dejanje. V Sloveniji do sedaj napovedovanju povratništva nismo posvečali pretirane pozornosti, letos pa je bil sprejet Zakon o probaciji, ki med drugim Upravi Republike Slovenije za probacijo nalaga strokovno obravnavo oseb, ki so vključene v probacijo, kar obsega pomoč pri identifikaciji vzrokov, ki so vplivali na storitev kaznivega dejanja in pri njihovem odpravljanju, pomoč pri razreševanju osebnih stisk in težav, pomoč pri urejanju življenjskih okoliščin in vzpostavljanju sprejemljivih oblik vedenja. Za potrebe priprave osebnega načrta oziroma za izdelavo poročila za sodišče, državnega tožilca ali komisijo za pogojni odpust, naj bi probacijska enota izdelala oceno dejavnikov tveganja in potreb po strokovni obravnavi za uspešnejšo vključitev osebe v družbo, kar nakazuje na bodočo uveljavitev psiholoških testov za napovedovanje povratništva tudi pri nas.

Title:Psychological aspecs of violence in Criminal Law
Abstract:
In today’s society aggression and violence are feared and try to be prevented one way or another. This can be tackled most effectively if we know, what triggers aggression. Psychological theories of aggressive behaviour list as causes internal factors, external factors or their mutual influence. Each theory focuses mostly on one of the causes; however aggressive behaviour can be in its entirety explained only by considering all causes. An individual is a constitution of body, soul and spirit and it would be impossible to a priori exclude the effect of thoughts or emotions on one’s behaviour. Understanding what causes aggressive behaviour can help us work professionally with those, who had behaved aggressively in their past and had been even convicted for it, but we want to prevent recidivism or the repetition of their aggressive behaviour. Psychological tests to predict recidivism can help at that, as they are mainly used to predict with high accuracy which offenders will repeat violent criminal act. Until now Slovenia has not been paying attention to predicting recidivism, but this year the Probation Act has been adopted, which, among other things, states that the Board of Republic of Slovenia for probation must treat professionally every person included in probation. That includes help in identifying causes, which influenced criminal acts, and in preventing them, help in solving personal distress and problems, help in arranging living conditions and establishing acceptable forms of behaviour. In order to prepare personal plans or make a report for court, public prosecutor or parole committee, the probation unit should make a risk and need assessment for professional treatment in order to make inclusion in society more successful, which points to a future enforcement of psychological tests to predict recidivism also in our country.
