According to a letter from a member of European parliament Annelise Dodds, which accuses the leading people of Formula 1 of actions that limit competition, the European Commission is considering to re-open proceedings against Formula 1. Specifically, Formula 1 is accused of three violations: (i) breach of the Arrangement between the FIA and the European Commission from 2001 and re-establishing control over both commercial and also regulation rights, (ii) unfair treatment of small teams by executing them from decision-making and (iii) uneven distribution of income from broadcasting rights between teams. Formula 1 proponents defend themselves with an argument that the special nature of sport puts Formula 1 outside of EU competition law. On the other hand, opponents argue that because of the economic impact of Formula 1, its actions fall under EU law. Due to the specific nature of sport and different line of arguments, the question is whether Formula 1 infringes competition law or do its actions fall under the specific nature of sport so there is no infringement at all.
