Abstract
Ljudem so ustavno priznane številne človekove pravice, med katerimi nekatere poznamo bolj, nekatere manj, za nekatere pa niti ne vemo, da obstajajo. Ena izmed pravic, ki jo ljudje premalo poznajo in se je premalo poslužujejo, je pravica dostopa do informacij javnega značaja. Gre za pravico, katere uresničevanje prinaša številne pozitivne učinke, med katerimi so najpomembnejši odprta, transparentna in državljanom približana javna uprava, ki zaradi omenjenih učinkov dosega višje zaupanje v svoje delovanje. Slovenija se glede zakonodajne ureditve pravice dostopa do informacij javnega značaja uvršča v sam vrh držav s priznavanjem te pravice. Pravica, ki je pri nas zapisana že v Ustavi Republike Slovenije, je postavljene temelje dodobra utrdila s sprejemom Zakona o dostopu do informacij javnega značaja, leta 2003. Do tega leta se je pravica "držala v ozadju." Kako pa je bilo po sprejetju zakona? Anketna raziskava pri naključnih anketirancih je pokazala, da so državljani Republike Slovenije s to pravico seznanjeni le toliko, da vedo za njen obstoj. Konkretno uveljavljanje pravice je še vedno na nizki ravni; razlog tiči verjetno predvsem v nevednosti državljanov, do katerih informacij lahko sploh dostopajo. Organi, ki so po ZDIJZ zavezani za posredovanje informacij javnega značaja, se določb zakona ne držijo, prepogosto se pojavlja molk organa. Z uveljavljanjem pravice dostopa do informacij javnega značaja in ne le s formalnim priznavanjem je Slovenija na dobri poti k učinkovitejšemu nadzoru nad državno oblastjo, k večji transparentnosti, legitimnosti, predvsem pa demokratičnosti svojega delovanja. Pravica omogoča odpravo pomanjkljivosti posredne demokracije in v ospredje postavlja participativno demokracijo.

Title:ENFORCEMENT AND COMPLIANCE WITH THE RIGHT OF ACCESS TO PUBLIC INFORMATION IN SLOVENIA
Abstract:
Many human rights have been acknowledged by the Constitution. Some of them are more, some less familiar to us and yet for some of them we do not know that they exist. One of less known human rights and less used as well, is the right to access the public information. It is the right that brings many positive effects, for example, making civil service more open, transparent and more user accessible. Consequently, the users demonstrate a higher level of trust into its work. Slovenia is in the top percentage in regards to making public information right accessible by law. This right can already be found in The Constitution of the Republic of Slovenia. Furthermore, in 2003 this right was yet again confirmed by passing The Public Information Act. Up until 2003 this right was less known, what about after passing The Public Information Act? The survey using random interviewees has shown that the citizens of the Republic of Slovenia are aware of it, while assertion of this human right is relatively low due to the fact that citizens lack knowledge which information is available to them. All of state bodies bound by The Public Information Act are not complying with the law, they tend to reduce to silence. With putting into effect the right to access public information, not just formally, Slovenia is well on its way to a more efficient control of the state authorities, and also to higher transparency, legitimacy and last but not least to a more democratic way of governing. This right enables the elimination of imperfections of the indirect democracy and puts forward the participatory democracy.
