Abstract
Nihče ne sme protipravno obogateti na račun drugega. Gre za splošno sprejeto načelo, ki pa je na razne načine upoštevano v pravnih redih po svetu. V magistrskem delu je opisana ureditev v slovenskem pravu, natančneje različne pravne podlage, ki omogočajo reševanje takšnih situacij. Gre predvsem za institut neupravičene obogatitve, splošna načela odškodninskega prava, ki se nanašajo na povrnitev škode, in določbe o prostem preudarku po zakonu o pravdnem postopku, ki sodišču olajšajo delo pri odmeri višine odškodnine. Ker pri odvzemu protipravno pridobljenega dobička lahko zaznamo vidik sankcioniranja in preventive, se dotaknem tudi kaznovalnih odškodnin in vprašanja skladnosti s slovensko Ustavo. Ideja t. i. »disgorgementa« ni tuja niti drugim ureditvam, zato je institut predstavljen tudi z vidika Konvencije o pogodbah o mednarodni prodaji blaga (CISG) ter uporabe instituta s strani uradov za varstvo konkurence v EU in ZDA.

Title:Disgorgement as a damage claim
Abstract:
No one should make a profit by a wrong. It is a common principle trough out the world that is applied in many different ways. The main aspect in the master thesis is the application of this principle in Slovenian private law, through law of unjust enrichment, law of damages and through some articles of civil procedural law. Because some authors see in the principle of disgorgement elements of sanctions and punitive damages, a part of thesis is intended to present these two elements in the light of Slovenian constitution. Since the principle of disgorgement is well known around the world there is also a brief introduction on this idea in the United Nations Convention on contracts for the international sale of goods (CISG) and the use of this principle by the EU and US competition agencies.
