Abstract
Načelo najboljše koristi otroka je norma, ki v največjem obsegu določa odločitev sodišča, kateremu od staršev bo po razvezi otrok zaupan v nadaljnje varstvo in vzgojo. Kljub temu da se zakonodaja in tudi stroka izogibata eksplicitnemu favoriziranju vloge mater, so otroci zaupani očetom le v 7 % primerov. Namen članka je prikazati, kako se obstoječe argumentiranje odločitev o zaupanju otrok v varstvo in vzgojo očetom razlikuje od obrazložitev zaupanja otrok materam. Sklepi sodišč izražajo 'konzervativni diskurz' ločenih socialnih sfer med moškim in žensko, ki skrb za otroke daje vdomeno mater, zmožnost, da za otroke skrbijo očetje, pa postavlja pod vprašaj. Analiza temelji na besedilu 25 sklepov sodišč o zaupanju otrok v varstvo in vzgojo enemu od staršev, med katerimi je 15 naključno izbranih primerov zaupanja otrok očetom in 10 naključno izbranih primerov zaupanja otrok materam.

Abstract:
The question of child custody after divorce is mainly guided by the principle of the best interest of the child. In Slovenian legislation there is no explicit rule that would distinguish the position of mother or father in custody determination. Nevertheless fathers win child custody in only 7 % of all cases. The aim of the article is to analyze differences in stating arguments of the court decisions in cases when sole custody rights are given to fathers in comparison to the cases in which sole custody is given to mothers. When deciding child custody courts decisions reveal 'conservative discourse of separate social spheres of man and woman' where mother has primary care giver role and where the capability of father to take care of children is questioned. The paper is based on analysis of the texts of the court decisions that reveal the prevailed social norms of suitable parental roles. It consists of 25 cases among which child custody was in 15 cases obtained by fathers and in 10 cases by mothers.
