Introduction: The globalisation of production, distribution and consumption, stemming from technological development, offers new opportunities on one hand and on the other hand exposes consumers to new risks. In order to ensure a high level of consumer protection the EU adopted Regulation (EU) 2023/988 on General Product Safety, which redefines the legal framework relevant for general product safety. Regulation (EU) 2023/988 on General Product Safety is fully binding and directly applicable in all member states. Purpose: The purpose of this master’s thesis is to present Regulation (EU) 2023/988 on General Product Safety and to analyse its implementation within the national legal framework. Methods: The research was conducted using a qualitative approach that included a content analysis of selected European and national legislative acts, as well as professional and scientific literature. The literature review was conducted according to predetermined inclusion and exclusion criteria. Historical and comparative legal methods were used to examine the legal framework governing general product safety. In the final stage of the master’s thesis, the synthesis method was applied. Results: The research has shown that the national legislation satisifies the requirements of Regulation (EU) 2023/988 on General Product Safety at the formal legal level by implementing The Act of the Implementation of the General Product Safety Regulation (EU). The Act of the Implementation of the General Product Safety Regulation (EU) provides mechanisms for ensuring product safety, determines the authorities in charge of market regulation, offences, and fines, as well as regulates the participation in the Safety Gate rapid alert system. In analysing the results of the Safety Gate rapid alert system between 2023 and 2025, we observed an increase in the number of notifications concerning dangerous products, chemical risks associated with cosmetic products remaining prevalent. Discussion and conclusion: Technological developments and the growth of online sales have transformed the consumer product market and increased the complexity of ensuring product safety. An appropriate legal framework is a necessary, but not the only, prerequisite for ensuring product safety. Assessing the effectiveness of regulation would require further monitoring and evaluation of results over a longer period of time.
