Abstract
S hitrim razvojem digitalne distribucije videoiger so se v praksi odprla številna pravna vprašanja glede lastništva in obsega pravic potrošnikov. Magistrska naloga v tem okviru obravnava pravni položaj uporabnikov videoiger v okolju digitalne distribucije. V ospredju je vprašanje, katere pravice uporabnik dejansko pridobi ob nakupu digitalne videoigre in v kolikšni meri se njegov položaj razlikuje od položaja kupca fizičnega izvoda. Naloga najprej predstavi pravno naravo videoiger kot kompleksna avtorska dela ter analizira posebnosti njihove distribucije, nato pa se osredotoči na ključno razlikovanje med prodajno in licenčno pogodbo ter na uporabo doktrine izčrpanja pravic pri digitalnih vsebinah. Posebna pozornost je namenjena končnim licenčnim pogodbam (EULA) in njihovemu vplivu na obseg pravic uporabnikov, zlasti glede možnosti enostranske ukinitve dostopa do digitalnih vsebin. Naloga na koncu predstavi aktualne odzive javnosti na tem področju. Posebej je izpostavljena evropska državljanska pobuda »Stop Destroying Videogames«, ki opozarja na nujnost ohranjanja dostopnosti digitalnih vsebin.

Title:Digital video games as objects of marketing and distribution
Abstract:
The rapid development of digital video game distribution has raised numerous legal challenges regarding actual ownership and the scope of consumer rights. In this context, the master's thesis examines the legal position of video game users within digital distribution environment. It focuses on the rights users acquire when purchasing a digital video game and the extent to which their position differs from that of a buyer purchasing a physical copy. The thesis first outlines the legal nature of video games as complex copyright works and analyses the specific characteristics of their distribution. It then explores the key distinction between sales contracts and licensing agreements, as well as the application of the doctrine of exhaustion of rights to digital content. Special attention is given to End-User License Agreements (EULA) and their impact on user rights, particularly concerning the unilateral termination of access to digital content. Finally, the thesis presents current public reactions in this area, highlighting the European Citizens’ Initiative “Stop Destroying Videogames”, which draws attention to the need to preserve access to digital content.
