Procesno-pravna problematika dodeljevanja javnih najemnih stanovanj v najem v Ljubljani : magistrsko delo

Magistrsko delo obravnava upravni postopek dodeljevanja javnih najemnih stanovanj v najem v Mestni občini Ljubljana s poudarkom na uresničevanju temeljnih načel upravnega postopka ter vlogi dokaznega postopka pri zagotavljanju zakonitosti in pravilnosti odločanja. Raziskava izhaja iz dejstva, da gre pri dodeljevanju javnih najemnih stanovanj za posebno obliko javnopravnega odločanja, pri katerem se prepletajo socialna funkcija države, varstvo javnega interesa ter procesna jamstva posameznikov. Zaradi omejenega števila razpoložljivih stanovanj in velikega števila prosilcev je vprašanje zakonitega, transparentnega in objektivnega odločanja posebej pomembno. V teoretičnem delu magistrskega dela obravnavamo nekatera temeljna načela upravnega postopka. Posebna pozornost je namenjena dokaznemu postopku, njegovemu pomenu pri ugotavljanju dejanskega stanja ter posameznim dokaznim sredstvom v upravnem postopku. Analiza vključuje tudi obravnavo pravne narave postopkov dodeljevanja javnih najemnih stanovanj ter sodne prakse Upravnega sodišča Republike Slovenije, ki pomembno vpliva na razlago procesnih standardov in nadzor nad zakonitostjo odločanja. V empiričnem delu magistrskega dela pa se osredotočamo na analizo normativne ureditve in praktičnih vprašanj dokazovanja v postopkih dodeljevanja javnih najemnih stanovanj v Ljubljani. Posebej sta obravnavani področji dokazovanja zdravstvenih razmer prosilcev in razvoj normativne ureditve na tem področju. Rezultati raziskave kažejo, da ima dokazni postopek ključno vlogo pri zagotavljanju zakonitosti, enake obravnave prosilcev in varstva njihovih procesnih pravic, pri čemer sta za pravilno odločanje bistvena dosledna uporaba načela materialne resnice ter ustrezno vrednotenje dokazov. Primerjalna analiza je pokazala, da slovenski sistem zagotavlja visoko raven procesnih jamstev in pravne varnosti, vendar je zaradi obsežnega dokaznega postopka tudi bolj formalno in administrativno zahteven.

• Title: Procedural-legal issues of allocating public apartments in Ljubljana

Abstract

This master's thesis examines the administrative procedure for the allocation of public rental housing in the Municipality of Ljubljana, with a particular focus on the implementation of the fundamental principles of administrative procedure and the role of the evidentiary procedure in ensuring the legality and correctness of decision-making. The research is based on the premise that the allocation of public rental housing constitutes a specific form of public-law decision-making in which the social function of the state, the protection of the public interest, and the procedural safeguards of individuals intersect. Due to the limited number of available housing units and the large number of applicants, ensuring lawful, transparent, and objective decision-making is of particular importance. The theoretical part of the thesis examines selected fundamental principles of administrative procedure. Special attention is devoted to the evidentiary procedure, its significance in establishing the facts of the case, and the various types of evidence used in administrative proceedings. The analysis also addresses the legal nature of public rental housing allocation procedures and the case law of the Administrative Court of the Republic of Slovenia, which plays an important role in the interpretation of procedural standards and the supervision of the legality of administrative decision-making. The empirical part of the thesis focuses on the analysis of the normative framework and the practical issues related to evidence in public rental housing allocation procedures in Ljubljana. Particular attention is paid to the verification of applicants' health conditions and the development of the legal framework governing this area. The research findings indicate that the evidentiary procedure plays a crucial role in ensuring legality, equal treatment of applicants, and the protection of their procedural rights, while the consistent application of the principle of substantive truth and the proper evaluation of evidence are essential for lawful decision-making. The comparative analysis has shown that the Slovenian system provides a high level of procedural safeguards and legal certainty; however, due to its extensive evidentiary procedure, it is also more formal and administratively demanding.
