Abstract
To magistrsko diplomsko delo za predmet razprave vzame pogodbo o dobavi toplote v daljinskih sistemih ogrevanja. Zaradi manjše prepoznavnosti tematike, je v prvem delu magistrskega dela na kratko pojasnjen sektor toplotne energije v Sloveniji kot tudi v Evropski Uniji. Bralcu se pojasnijo pojmi toplote, toplotne energije ter njene prednosti in slabosti. Iz splošne razlage nato v drugem delu magistrsko delo prikaže zakonodajno ureditev energetskega sektorja v Sloveniji, ki je razdrobljena in v konkretni meri prepuščena v urejanje zasebnim gospodarskim subjektom, ki pod strogim nadzorom regulatorne agencije, sami urejajo pravice in obveznosti odjemalcev toplotne energije. Te pravice in obveznosti odjemalcev toplote kot tudi distributerjev toplote, pa morajo biti podrobneje urejene v pogodbi o dobavi toplote. Z njenimi lastnosti se tako podrobneje ukvarja tretji del magistrskega dela. V tem delu bo predstavljen tudi mehanizem izračuna cene toplotne energije, ter z njo zvezan mehanizem regulacije le-te. Podrobneje bodo predstavljene tudi njene posebnosti kot je na primer zahtevana obličnost pogodbe o dobavi toplote, in kako seta zahteva bolj ali manj spoštuje v praksi. V zadnjem delu magistrskega dela pa bo beseda tekla o omejeni odpovedi pogodbe o dobavi toplote. Zaradi razlogov, ki bodo obrazloženi, je namreč pogodba o dobavi toplote ob izpolnitvi razlogov, ki so zunaj vpliva pogodbene stranke, lahko neodpovedljiva in trajna.

Title:Heat Supply Contract in District Heating Systems: Contractual Characteristics and Practical Challenges
Abstract:
This master's thesis takes as its subject of discussion the contract for the supply of heat in district heating systems. Due to the low recognition of the topic, the first part of the thesis briefly explains the heat energy sector in Slovenia and the European Union. The reader is introduced to the concepts of heat, thermal energy, and its advantages and disadvantages. Following the general explanation, the second part of the master's thesis presents the legislative regulation of the energy sector in Slovenia, which is fragmented and, to a large extent, left to private commercial entities to regulate, who, under the strict supervision of the regulatory agency, regulate the rights and obligations of thermal energy consumers themselves. These rights and obligations of heat consumers and heat distributors must be regulated in more detail in the heat supply contract. The third part of the master's thesis deals with its characteristics in more detail. This part will also present the mechanism for calculating the price of the heat supply and the related mechanism for regulating it. The contract's specific features will also be presented in more detail, such as the required form of the heat supply contract and how this requirement is more or less respected in practice. The last part of the master's thesis will discuss the limited termination of heat supply contracts. For reasons that will be explained, a heat supply contract may be non-terminable and permanent if conditions beyond the control of the contracting parties are met.
