Odpravljanje prisile kot sredstvo dezinstitucionalizacije : doktorska disertacija

Abstract
V doktorski disertaciji raziskujemo strategije zmanjševanja in odpravljanja uporabe prisile v duševnem zdravju v okviru dezinstitucionalizacije. Besedilo temelji na mednarodnih standardih človekovih pravic, zlasti na Konvenciji Združenih narodov o pravicah invalidov. Raziskava je bila izvedena v okviru projekta preobrazbe posebnega socialnovarstvenega zavoda Dom na Krasu med letoma 2020 in 2023. Uporabili smo akcijsko raziskovanje. Raziskovalni problem je bil spoznati realnost v danem raziskovalnem polju glede na analitične ravni iz teoretičnega dela disertacije; v praksi zmanjšati ali odpraviti uporabo prisile na varovanem oddelku in drugih oddelkih socialnovarstvenega zavoda; ter povezati spoznanja iz teorije in prakse v enovit program dezinstitutionalizacije varovanih oddelkov. Podatke smo zbrali z delovanjem, vključno z neposrednim delom s stanovalci, pogovori, opazovanjem in dokumentiranjem. Ugotovitve kažejo, da ureditve na varovanem oddelku (predvsem zaklenjena vhodna vrata in več splošnih varnostnih ukrepov) tamkajšnje stanovalce omrtvičijo, saj omejujejo njihov življenjski svet in jih delajo odvisne od osebja. S tem varovani oddelek ne izpolnjuje svoje zakonsko določene vloge in se kaže kot neustrezna oblika dela. Pri rabi metod dela, ki so jih v zavodu uporabljali na institucionalni način, je akcijskoraziskovalna skupina uspela pokazati potencial metod za delo brez prisile. Postopki namestitve na varovani oddelek so ceremonije ponižanja, ki uporabnike označujejo za nevarne, da bi utemeljili njihovo upravičenost za dostop do »intenzivnejše« oskrbe. Odpusti so bili med raziskavo redki, saj jih je oviralo veliko dejavnikov (predvsem pomanjkanje in fragmentacija skupnostnih služb). Varovani oddelek je v sistemu služb in v zavodu prostor za izločanje domnevno nevarnih. Med projektom poskusi spreminjanja organizacijskih ureditev, s katerimi bi odpravili ali vsaj zmanjšali prisilo, niso uspeli. Potrebna je celovita reforma, ki temelji na človekovih pravicah. Varovane oddelke je treba kot prostore odpraviti in jih nadomestiti z različnimi skupnostnimi oblikami podpore, ki jih izvajajo medsebojno povezane skupnostne službe. Politika in zakonodaja morata za odpravo prisile delovati proaktivno in dosledno.

Title:Abolishing coercion as a means of deinstitutionalisation
Abstract:
This doctoral dissertation examines strategies to reduce and eliminate the use of coercion in mental health care within the context of deinstitutionalisation. It is grounded in international human rights standards, particularly the United Nations Convention on the Rights of Persons with Disabilities. The research was conducted as part of a project to transform the Dom na Krasu residential social care institution between 2020 and 2023, using an action research approach. The study aimed to understand the realities of the research setting in relation to the theoretical framework; to reduce or eliminate coercive practices in the secure (closed) unit and other units of the institution; and to integrate theoretical and practical insights into a coherent deinstitutionalisation programme for secure units. Data were collected through action (including direct work with residents), conversation, observation, and documenting. The findings indicate that the organisational arrangements of the secure unit (particularly the locked doors and generalised security measures) restrict residents’ living environments and increase their dependence on staff. As a result, the secure unit fails to fulfil its legally defined role and represents an inappropriate form of care. The action research group demonstrated that certain methods have the potential for non-coercive work. Admission procedures to the secure unit function as degradation ceremonies, labelling users as dangerous to justify their access to “intensive” care. Discharges were rare, largely due to fragmented and insufficient community-based services. Within community services and the institution itself, the secure unit serves as a site of exclusion for those deemed dangerous. Efforts to reduce coercion through organisational change were unsuccessful. Secure units should be abolished and replaced by diverse, interconnected community-based forms of support. Consistent and proactive policy and legislation are essential to eliminate coercion.
