Vpliv šeriatskega prava na sodobne pravne ureditve arabskih držav

Abstract
V tej nalogi se ukvarjam z vprašanjem, kakšen vpliv ima šeriatsko pravo na sodobno pravo v izbranih arabskih državah. Najprej definiram šeriatsko pravo, njegove vire in različne islamske pravne šole. Nato se posvetim področju družinskega prava in si postavim hipotezo, da je vpliv šeriatskega prava na sodobno pravo na tem področju velik. To sem ugotovila preko analize zakonodaje, ki šeriat v vseh obravnavanih državah omenja kot pravni vir za sodobno ureditev, in sodnega sistema. V izbranih deželah je značilno, da obstajajo posebna šeriatska sodišča, ki odločajo v zadevah družinskega prava. Gre torej za dvotirnost sodnega sistema. Nadalje sem to hipotezo potrdila tudi preko analize zakonodajne ureditve instituta razveze zakonske zveze v izbranih državah. Ugotovila sem, da se v nobeni od držav skorajda ne razlikuje od ureditve instituta po šeriatskem pravu. Ugotovila sem tudi, da se ureditve med državami skorajda ne razlikujejo, saj sem dognala, da sledenje stališčem različnih islamskih pravnih šol v različnih državah nima bistvenega (ali skoraj nobenega) vpliva na ureditev instituta razveze. Vse to me je pripeljalo do zaključka, da ima šeriatsko pravo na sodobno družinsko pravo arabskih držav večji vpliv, kot sem si predstavljala.

Title:The influence of Sharia law on contemporary legal systems in Arab countries
Abstract:
In this paper, I address the question of how Sharia law influences contemporary law in selected Arab countries. First, I define Sharia law, its sources, and the various Islamic legal schools. Then I focus on the area of family law and put forward the hypothesis that Sharia law has a significant impact on contemporary law in this area. I came to this conclusion through an analysis of legislation, which mentions Sharia as a legal source for contemporary regulation in all the countries under consideration, and the judicial system. It is characteristic of the selected countries that there are special Sharia courts that decide on family law matters. This means that there is a dual judicial system. I further confirmed th hypothesis by analyzing the legal regulation of divorce in the selected countries. I found that in none of the countries does it differ significantly from the regulation of divorce under Sharia law. I also found that the regulations between countries hardly differ, since I found that following the views of different Islamic legal schools in different countries has no significant (or almost no) impact on the regulation of divorce. All of this led me to conclude that Sharia law has a greater influence on contemporary family law in Arab countries than I had imagined.
