Abstract
Magistrsko delo obravnava vprašanje uporabe ter vpliva pravne regulacije v času aktualne energetske krize ter analizira rešitve in ukrepe, ki jih omogoča veljavni pravni okvir. Problematika je uvodoma predstavljena skozi prizmo preteklih energetskih kriz, ki so ključno vplivale na razvoj prava na relevantnem področju. Prve izkušnje, ki jih zasledimo v evropskem prostoru kažejo na odsotnost usklajenega odziva na nadnacionalni ravni, med tem ko izhodišče za razumevanje trenutne energetske krize predstavlja obdobje, ki je sledilo prvi in drugi ukrajinski plinski krizi. Analiza, ki je naprej osredinjena na razvoj prava v tem obdobju ter odziv Evropske unije na aktualno energetsko krizo, kot ključno izpostavi načelo energetske solidarnosti ter njegove razsežnosti v praksi. Med tem ko institucije Evropske unije zagovarjajo njegovo široko uporabo, preko katere bo zagotovljen skupen odziv ter poglobljena integracija notranjega trga, na drugi strani države članice vztrajajo pri njegovi ozki razlagi. Nadalje je predstavljena politika Evropske komisije, ki v kriznih obdobjih dopušča gibljivo razlago temeljnih pravil prava Evropske unije, kar je omogočilo širšo uporabo ukrepov tudi v obdobju aktualne energetske krize. Na tem mestu velja omeniti, da specifična sektorska regulacija, ki ureja področje energetike, načeloma že vnaprej nekoliko drugače naslovi združljivost ukrepov, kot so državne pomoči in regulacija cen, z notranjim trgom. V okviru širšega pregleda je nadalje kritično naslovljena vloga, ki sta jo v obravnavanem obdobju v Republiki Sloveniji imela neodvisni regulator na področju energetike ter nacionalni organ, ki je zadolžen za varstvo konkurence. Nazadnje je potrebno izpostaviti, da bo pomembno vlogo pri nadaljnjem razvoju energetske unije, ki jo bo ključno zaznamoval zeleni prehod, predstavljalo učinkovito sodelovanje med javnim in zasebnim sektorjem.

Title:The impact of legal regulation on the energy crisis and the solutions provided by the legal framework
Abstract:
The master’s thesis examines the application and impact of legal regulation during the current energy crisis and analyzes the solutions and measures enabled by the applicable legal framework. The issue is initially presented through the lens of past energy crises, which have significantly influenced the development of law in the relevant field. Early experiences in the European context reveal the absence of a coordinated response at the supranational level, while the basis for understanding the present crisis lies in the period following the first and second Ukrainian gas crises. The analysis, which subsequently focuses on the development of law during this period and on the European Union’s response to the current energy crisis, highlights the principle of energy solidarity and its scope in practice. While the institutions of the European Union advocate for its broad application, intended to ensure a joint response and a deeper integration of the internal market, the Member States continue to insist on its narrow interpretation. Furthermore, the thesis discusses the policy of the European Commission, which, in times of crisis, allows a flexible interpretation of the fundamental rules of EU law, thereby enabling a broader use of measures even during the current energy crisis. It should also be noted that sectorspecific regulation in the energy sector generally anticipates the compatibility of measures such as state aid and price regulation with the internal market. Within this broader framework, the thesis also critically examines the role played during the observed period in Slovenia by the independent energy regulator and the national authority responsible for competition protection. Finally, it is emphasized that effective cooperation between the public and private sectors will play a crucial role in the further development of the Energy Union, which will be shaped by the green transition.
