Abstract
V magistrski nalogi obravnavamo različne scenarije množične katastrske preureditve nepozidanih stavbnih zemljišč z namenom priprave zemljišč za stanovanjsko gradnjo. Izhodišče raziskave je izziv, s katerim se soočajo prizadete občine po poplavah leta 2023, zlasti občina Braslovče, ki mora za prebivalce zagotoviti ustrezna gradbena zemljišča za nadomestno gradnjo. V nalogi analiziramo tri scenarije katastrskih preureditev z vsemi potrebnimi postopki: parcelacija po občinskem podrobnem prostorskem načrtu (OPPN), pogodbena komasacija in upravna komasacija. Namen raziskave je ugotoviti, kateri postopek je najprimernejši za izvedbo prostorskega načrta na izbranem območju za predlagan namen. Raziskava vključuje študijo zakonodaje in simulacije postopkov na konkretnem primeru. Ob simulacijah so upoštevani različni lastniški scenariji ter tehnični in pravni pogoji za izbrani pristop katastrskega preurejanja. Ugotovljeno je, da izbira postopka katastrskega preurejanja za namene gradnje zahteva upoštevanje več dejavnikov, med katerimi so ključni usklajenost interesov lastnikov, stopnja urejenosti parcelnih meja in veljavnost OPPN. Ob zaključku naloge smo izvedli primerjalno analizo katastrskega preurejanja zemljišč, z namenom oblikovati priporočila glede optimalne realizacije prostorskega izvedbenega načrta, kjer posebej obravnavamo postopke z vidika učinkovitosti in pravne izvedljivosti.

Title:Analysis of scenarios for mass cadastral rearrangement of unbuilt building land : master thesis
Abstract:
In this master’s thesis, we examine various scenarios of large-scale cadastral land plot rearrangement of undeveloped building land with the aim of preparing land for residential construction. The starting point of the research is the challenge faced by municipalities affected by the 2023 floods, particularly the Municipality of Braslovče, which must provide suitable building plots for replacement construction for its residents. The thesis analyses three scenarios of cadastral land plot rearrangement with all necessary procedures: land subdivision according to the municipal detailed spatial plan (OPPN), contractual land consolidation, and administrative land consolidation. The purpose of the research is to determine which procedure is most appropriate for implementing the spatial plan in the selected area for the proposed purpose. The study includes a review of relevant legislation and simulations of the procedures on a specific case. The simulations consider different ownership scenarios as well as the technical and legal conditions for the selected cadastral reallocation approach. The findings indicate that the choice of a cadastral rearrangement procedure for construction purposes requires consideration of several factors, the most important being the alignment of landowners’ interests, the level of boundary demarcation, and the validity of the OPPN. At the conclusion of the thesis, a comparative analysis is conducted to provide recommendations on the optimal approach to cadastral land reallocation for the efficient use of building land, with particular attention to the effectiveness and legal feasibility of the procedures.
