Abstract
Gradbena pogodba ustvarja dinamično in zahtevno pogodbeno razmerje, saj jo spremljajo dolgotrajen proces izvedbe, visoki stroški in številna tveganja, povezana z zunanjimi dejavniki. Zaradi svoje kompleksnosti in življenjskih tveganj je pogodbena cena posebej dovzetna za spremembe, ki lahko tekom izvajanja pogodbe nastanejo iz različnih razlogov. Magistrska naloga se osredotoča na primerjavo ureditve spremembe cene v Obligacijskem zakoniku, Posebnih gradbenih uzancah ter v pogodbah FIDIC (Rdeča in Rumena knjiga). V teoriji in praksi se kot vzroka, ki najpogosteje spreminjata ceno, omenja predvsem spremenjen obseg del in sprememba v cenah elementov, ki vplivajo na stroške gradnje. Magistrska naloga obravnava še primerjavo ureditev posledic v primeru spremembe cene, ki izvirajo iz ravnanja oblasti, nepravilne časovne izpolnitve in uresničitve zunanjih nepredvidljivih okoliščin. V zaključku so izpostavljene najpomembnejše ugotovitve, podobnosti in razlike, ki so se pokazale pri primerjavi ureditev v primerjanih pravnih virih.

Title:Comparison of the regulation of contractual price changes in construction contracts under Slovenian law and FIDIC contracts
Abstract:
A construction contract establishes a dynamic and demanding contractual relationship, as it involves a lengthy implementation process, high costs, and numerous risks associated with external factors. Due to its complexity and associated life risks, the contract price is particularly susceptible to changes that may arise for various reasons during the contract's performance. This master’s thesis focuses on a comparison of the regulation of price changes in the Obligations Code, Special Construction Practices, and FIDIC contracts (Red and Yellow Books). Both in theory and in practice, the most common causes of price changes are variations in the scope of work and fluctuations in the prices of elements affecting construction costs. In addition to these causes, the thesis also examines the consequences of price changes resulting from governmental actions, incorrect scheduling and the occurrence of unforeseeable external circumstances. In conclusion, the author highlights the most significant findings as well as the key similarities and differences identified in the comparison of the selected legal sources.
