Abstract
Jugoslavija je leta 1974 postala prva država, ki je ustavno zaščitila pravico do abortusa. Po osamosvojitvah pa sta se kljub skupni socialistični dediščini Slovenija in Hrvaška, kar zadeva 55. člen ustave, razvijali drugače. Zadnja leta smo priča obdobju, ko nosečnice s Hrvaške potujejo v Slovenijo, da opravijo umetno prekinitev nosečnosti. V veliki meri je to ena izmed posledic množičnega sklicevanja zdravnikov in medicinskega osebja na pravico ugovora vesti na Hrvaškem, kjer je pojav posebej razširjen. Na pravno-formalni položaj in dejansko uresničevanje pravice do abortusa poleg ugovora vesti vplivajo tudi rekatolizacijske težnje Rimskokatoliške cerkve in z njo povezanih konservativnih skupin. Kot pomembna protiutež regresivnim težnjam pa se dokazujejo civilne skupine in nevladne organizacije, ki se z različnimi strategijami borijo za dostopnost varnega abortusa na zahtevo za vse nosečnice.

Title:Factors Influencing the Legal Framework and the Practical Implementation of the Right to Abortion in Slovenia and Croatia
Abstract:
In 1974, Yugoslavia became the first country to enshrine the right to abortion in its constitution. However, after gaining independence, Slovenia and Croatia, despite their shared socialist legacy, took different paths regarding Article 55 of the constitution. In the past years we have been witnessing a trend where pregnant individuals are traveling from Croatia to Slovenia to access abortion services. This is largely a consequence of the widespread invocation of the right to conscientious objection by doctors and medical staff in Croatia, where such practices are particularly prevelent. Alongside conscientious objection, the legal and practial realization of abortion rights is shaped by the re-Chatolization efforts of the Roman Catholic Church and the conservative groups associated with it. A significant counterbalance to these regressive tendencies, civil society groups and non-governmental organizations have emerged, employing various strategies to advocate for accessible and abortion on request for all pregnant individuals.
