The master's thesis addresses the procedural and legal issues of granting Zois scholarships. The core research focus lies in examining the application of the General Administrative Procedure Act (ZUP) in the context of specific provisions introduced by the Scholarship Act (ZŠtip-1) which, due to the complexity of the administrative area, functions as a lex specialis. The study analyzes how fundamental procedural principles such as legality, material truth, the right to be heard, compliance with deadlines, and proper service of decisions are implemented in practice.
The research in based on a combination of qualitative and quantitative methods, including legal analysis and judicial practice, review of statistical data and internal documents of Public Scholarship, Development, Disability and Maintenance Fund of the Republic of Slovenia, an interview with the director of the Fund and a comparative case study of scholarship systems for talented students in Croatia.
The findings of the thesis indicate that although the Fund's practice is adapted to the specifics of the administrative procedure for granting the Zois scholarship, the lex specialis does not regulate all necessary specifics in full. As a result, practice deviates from the rules of the ZUP. This suggests that ZUP is not optimal for this type of administrative procedure, and therefore it is essential for ZŠtip-1 to appropriately regulate the special procedural norm where justified.
Judicial practice futher warns the unlawfulness of certain provisions of the Rules on the Awarding of the Zois Scholarship, which in several cases exceed the legal framework set out in the ZŠtip-1. During the Covid-19 pandemic, differences in the interpretation of intervention legislation were detected between administrative and judicial authorities, especially at assesing the exceptional conditions for granting a scholarship. However, according to the explanation of the interviewed director of the Fund, these intervention legislations did not have a significant impact on the procedural elements of the administrative process, as the changes mainly related to the conditions for the granting Zois Scholarship.
