Abstract
Magistrsko delo, z naslovom Položaj otrok brez spremstva kot prosilcev za mednarodno zaščito, raziskuje pravni položaj otrok brez spremstva, ki zaprošajo za status mednarodne zaščite in preučuje, kako mednarodno pravo ščiti to ranljivo skupino. Obravnava tako Konvencijo o statusu beguncev kot tudi Konvencijo o otrokovih pravicah in analizira zaščitne mehanizme, ki so vzpostavljeni na evropski ravni. Poudarjena je pomembnost načela otrokove največje koristi in izzivi, s katerimi se soočajo države pri obravnavi teh otrok. Posebno pozornost posveča tudi primerom dobre in slabe prakse v državah članicah EU, vključno s Slovenijo, ter oceni, ali so otroci brez spremstva ustrezno obravnavani. Vključen je pregled mednarodnega in evropskega prava ter nacionalne ureditve v Sloveniji.

Title:The Status of Unaccompanied Children as Applicants for International Protection
Abstract:
The thesis explores the legal status of unaccompanied children seeking international protection, focusing on how international law addresses the protection of this vulnerable group. It examines the Refugee Convention and the Convention on the Rights of the Child and assesses protective mechanisms established at the European level. The importance of the principle of the best interests of the child is emphasized, along with the challenges countries face in properly addressing these children’s needs. Special attention is given to examples of good and bad practices within EU member states, including Slovenia, assessing whether unaccompanied children are adequately protected. The study provides a review of international and European law and Slovenia’s national framework.
