Nepremičninska izvršba in sodna dražba na primeru izbranega sodišča : diplomsko delo

Abstract
V Sloveniji se v zadnjih letih ponovno povečuje plačilna nedisciplina, kar posledično privede do prisilne izterjave dolga po sodni poti. Upniki imajo več možnosti za izterjavo svojega dolga, bistvenega pomena pa je, da pridejo hitro in enostavno do poplačila terjatve. Sodni izvršilni postopek poteka razmeroma hitro in za stranke razmeroma enostavno. Izvršilna sodišča so popolnoma digitalizirala postopek izvršbe, kar pomeni, da so s tem povečali dostopnost do podatkov iz elektronskega spisa in s tem tudi možnost do hitrejšega poplačila upnikove terjatve. Zaradi digitalizacije sistema upniki hitreje dostopajo do podatkov o morebitnem dolžnikovem premoženju in s tem tudi lažje določijo izvršilno sredstvo, s katerim bodo poskušali priti do poplačila svoje terjatve. Upniki praviloma poskušajo doseči poplačilo svoje terjatve s predlaganimi sredstvi, ki so tudi za dolžnika najugodnejši. Možno sredstvo za poplačilo upnikove terjatve je tudi izvršba na dolžnikove nepremičnine, ki pa naj bo skrajni ukrep in ne pravilo. Izvršba na nepremičnine je za upnika dolgotrajen in drag postopek, za dolžnika pa neprijeten ter stresen, poleg vsega pa ni nujno, da je uspešen. V Sloveniji poteka prodaja nepremičnin dolžnika preko javne dražbe, od leta 2021 pa tudi elektronsko, kar je dodatno olajšalo izvedbo prodaje. Z elektronsko prodajo nepremičnin se povečuje uspešnost prodaje in s tem poplačilo upnikove terjatve.

Title:Enforcement on real estate and judicial auction in the case of chosen court
Abstract:
In Slovenia, payment indiscipline has been on the rise again in recent years, which has consequently led to judicial debt recovery. Creditors have many different possibilities for recovering their debts but it is crucial that the repayment of debts is quick and easy. The judicial enforcement procedures are quick and relatively easy for clients. The enforcement courts have completely digitalized the enforcement process and so they have increased the accessibility of the data from the electronic files and also the possibility for a faster creditor's debt repayment. Because of the digitalization of the system, creditors can now more quickly access the data on the potential debtor's assets, so they can easily determine the means of enforcement, with which they will try to get the repayment of their claims. Creditors generally try to achieve the repayment of their claims with proposed means, which are also the most favorable for the debtor. One of the means for debt repayment is also an execution on the immovable property, but it should be a drastic measure and not the rule. An execution of the immovable property is an expensive and long-lasting procedure for the creditor and unpleasant and stressful for the debtor and success is not ensured. In Slovenia, the debtor's immovable property is sold through a public auction, and from 2021 also by electronic, which further facilitates the execution of the sale. The electronic sale of immovable property increases the success of the sale and thus the repayment of the creditor's claim.
