Abstract
V magistrskem delu so obravnavani problematika in izzivi postopkov javnega naročanja. Magistrsko delo v zgodovinsko-teoretičnem delu zajema opredelitev temeljnih pojmov, zgodovino javnega naročanja, pravno ureditev ter opis organov in institucij, ki sodelujejo v postopku javnega naročanja. V analitičnem delu je predstavljena problematika javnega naročanja in mednarodna primerjava med državami članicami EU. Ob koncu magistrskega dela so podane rešitve in predlogi izboljšav. Namen magistrskega dela je bil ugotoviti, s kakšnimi problemi in izzivi se soočajo stranke v postopkih javnega naročanja. V magistrskem delu je uporabljenih več različnih metod raziskovanja: pregled literature, induktivna metoda, metoda analize, metoda kompilacije in sintetična metoda. V magistrskem delu je bilo ugotovljeno, da RS daje velik poudarek na področje javnega naročanja. V zvezi s tem je sprejela mnogo reformnih ukrepov, oblikovala kompetenčni model za profesionalizacijo izvajalcev javnih naročil in se vključila v projekt sistemskega pristopa celovitega področja javnega naročanja. Kljub temu pa obstaja manevrski prostor za izboljšave. Bistven doprinos magistrskega dela k praksi oziroma stroki so ugotovitve glede kršitev javnega naročanja. V povezavi z uspešnostjo izvajanja javnih naročil v RS je prispevek magistrskega dela predvsem v ugotovitvah, kako uspešna je RS v primerjavi z drugimi državami članicami EU, ter kako na uspešnost javnega naročanja vpliva skupno javno naročanje. Končni prispevek magistrskega dela k praksi oziroma stroki so predlogi izboljšav na področju javnega naročanja. Magistrsko delo predstavlja spodbudo za nadaljnje proučevanje področja javnega naročanja in reševanje problematike gospodarne porabe javnih financ.

Title:Problems and challenges of public procurement procedures
Abstract:
The master's thesis addresses the issues and challenges of public procurement procedures. The historical-theoretical part of the thesis includes the definition of key concepts, the history of public procurement, legal regulations, and a description of the bodies and institutions involved in the public procurement process. The analytical part presents the issues of public procurement and provides an international comparison between EU member states. At the end of the thesis, solutions and suggestions for improvements are provided. The purpose of the master's thesis was to identify the problems and challenges faced by the parties involved in public procurement procedures. The thesis uses several research methods: literature review, inductive method, analytical method, compilation method, and synthetic method. The thesis concluded that Slovenia places great emphasis on the field of public procurement. In this regard, it has implemented numerous reform measures, developed a competence model for the professionalization of public procurement contractors, and joined a project for a systemic approach to the comprehensive field of public procurement. However, there is still room for improvement. The significant contribution of the master's thesis to practice and the profession lies in the findings regarding violations in public procurement. In connection with the success of public procurement in Slovenia, the main contribution of the thesis is in the findings about how successful Slovenia is in comparison to other EU member states and how joint public procurement affects the success of public procurement. The final contribution of the thesis to practice and the profession is the proposals for improvements in the field of public procurement. The master's thesis serves as an impetus for further study of public procurement and addressing the issues related to the efficient use of public finances.
