Abstract
Namen sodobne in dobro vzdrževane infrastrukture za delovanje in razvoj post-informacijske družbe je velikokrat spregledana. Kljub pomembnosti človeških virov in socialne kohezije je vedno potrebna realna materialna osnova, ki se veča na račun načrtovanja, gradnje in vzdrževanja različnih oblik infrastrukture z večinskim delom na področju gradbeništva. Dandanes je v pravnem sistemu v veljavi preveliko število predpisov, za katere bi se vprašali, ali je njihova prisotnost sploh potrebna. Žal je slovenski pravni sistem preveč obsežen, kar je za seboj prineslo nastanek t. i. administrativnih ovir, ki so trn v peti vsem sodelujočim. Ovire so razlog za neučinkovito delovanje države, s čimer se podaljšujejo postopki za izdajo gradbenega dovoljenja in se temu primerno povečuje slaba volja. V zadnjih letih se je tako pojavila želja po hitrejši dostopnosti, preglednost, nakar je prišla želja po vpeljavi informacijskega sistema. Informatizacija postopkov je s seboj prinesla uzakonitev novih zakonov, zaradi slabo razumljivih predpisov pa tudi nerazumevanje posameznih določb, kar pomeni nepravilno tolmačenje zakonov. Magistrsko delo je ključnega pomena za gradbeno področje, saj opozarja na najpogostejše probleme, ki so prevelika kompleksnost sprejetih predpisov in številčnost le-teh, slaba kakovost upravnega postopka ter njegova dolgotrajnost. Z delom so tako predstavljene dileme znotraj integralnega postopka izdaje gradbenega dovoljenja in rešitve, ki bi bile lahko bile ključ do hitrejšega reševanja upravnih zadev ter s tem varovanja javnega interesa ter spoštovanja interesa strank. Prav tako je z odgovori na raziskovalna vprašanja mogoče prepoznati cilje integralnega postopka, ki v večji meri slonijo na hitrejši izdaji dovoljenja, zmanjšanju potrebne dokumentacije in razbremenitvi uradnih oseb.

Title:Legal and empirical analysis of the integral procedure of issuing a building permit
Abstract:
The purpose of modern and well-maintained infrastructure for the operation and development of the post-information society is often overlooked. Despite the importance of human resources and social cohesion, a real material basis is always needed. Only this increases at the expense of planning, construction and maintenance of various forms of infrastructure with the majority of work in the field of construction. Nowadays, there are too many regulations in force in the legal system, for which one would wonder if their presence is even necessary. Unfortunately, the Slovenian legal system is too extensive, which has resulted in the creation of the so-called administrative obstacles, which are a thorn for any participant in the procedure. Obstacles are the reason for the ineffective functioning of the state, which prolongs the procedures for issuing a building permit and correspondingly increases ill will. In recent years, there has been a desire for faster accessibility and transparency, which has led to the desire to introduce an information system. The informatization of procedures has brought with it the enactment of new laws, as well as misunderstanding of individual provisions due to poorly understood regulations, which means incorrect interpretation of law. The master's thesis is of key importance for the construction field, as it points to the most common problems, which are the excessive complexity of the adopted regulations and the number of them, the poor quality of the administrative procedure and its long duration. The work thus presents dilemmas within the integral process of issuing a building permit and solutions that could be the key to faster resolution of administrative matters and thereby protecting the public interest and respecting the interests of the clients. Also, with the answers to the research questions, it is possible to identify the goals of the integral procedure, which are based to a greater extent on the faster issuance of the permit, the reduction of the necessary documentation and the relief of officials..
