Tihotapljenje drog v južni Kitajski: Preventivni ukrepi kitajskih oblasti v prvih desetletjih 21. stoletja

Abstract
Ta raziskava analizira pravni red, katerega uvaja Kitajska glede zakonodaje o boju proti nezakoniti trgovini s prepovedanimi drogami, zlasti v južnih provincah LRK, ki mejijo na območje Zlatega trikotnika, največjega svetovnega dobavitelja drog. Časovno obdobje raziskave zajema obdobje 2010-2020, ko je bila regija priča razmahu nezakonitega prometa s prepovedanimi drogami, zlasti s stimulansi amfetaminske vrste (ATS), in pojavu novih psihotropnih snovi (NPS). Uvajanje preventivnih ukrepov temelji na kazenskem zakoniku Ljudske republike Kitajske, določbah zakona o boju proti prepovedanim drogam in številnih ustreznih predpisih, ki so bili obravnavani v času razvoja, namreč od prvih ukrepov kitajskih organov za nadzor nad trgovino z drogami v devetdesetih letih prejšnjega stoletja do danes. V praksi ima kitajska strategija za boj proti prepovedanim drogam tri glavne stebre, in sicer preprečevanje tihotapljenja drog v državi, mednarodno sodelovanje in sodelovanje z družbo, vključno z zdravljenjem in rehabilitacijo odvisnikov od drog ter množično propagando proti drogam. Posledično so bili ukrepi oblasti usmerjeni v zaostrovanje kazni za kršitve zakonodaje o boju proti prepovedanim drogam in drakonske ukrepe za zdravljenje odvisnikov od drog, zaradi česar se je število kaznivih dejanj, povezanih z drogami, do leta 2020 zmanjšalo. Hkrati z odpravljanjem nacionalne zasvojenosti z drogami pa je Kitajska spremenila svojo vlogo v svetovni trgovini z drogami, in sicer se je iz tranzitne države in države potrošnje preobrazila v svetovno dobaviteljico surovin za izdelavo prepovedanih drog.

Title:Drug Trafficking in South China: Preventive Measures of the Chinese Authorities in the 2010s and 2020s
Abstract:
This study analyses the practical consequences of China's implementation of preventive measures against drug trafficking for China and the world taken in the context of the South China territories, bordering the “Golden Triangle” zone, the biggest world supplier of drugs. This research covers the period from 2010 to the 2020s, during which the illegal drug trade thrived in the region, particularly with amphetamine-type stimulants (ATS) as well as the emergence of new psychotropic substances (NPS). The implementation is based on the Criminal Code of the People’s Republic of China, and “Anti-Drug Law” regulations, which have been strengthened with various relevant normative acts. These have been examined as they evolved, from the initial steps taken by the Chinese authorities to control drug trafficking in the 1990s to the present. On the practical side, the Chinese strategy for drug control focuses on three main areas: preventing drug smuggling within the country, international cooperation, and societal efforts, including both drug treatment and rehabilitation, as well as mass anti-drug propaganda. As a result, authorities have implemented severe punishments for the violation of anti-drug laws and taken draconian measures to treat drug addicts, resulting in a decrease in drug-related crimes by the 2020s. As China has successfully reduced domestic drug abuse, its role in the global drug trade has shifted from being a transit and consumption country to becoming the world’s supplier of raw drug materials.
